<br />D. Pursuant to Health and Safety Code
<br />Section 33426.5, the agency shall not pro-
<br />vide any form of direct assistance to the fol-
<br />lowing:
<br />1. An automobile dealership that will be or
<br />is on a parcel of land that has not previously
<br />been developed for urban use.
<br />2. A development that will be or is on a
<br />parcel of land of five acres or more that has
<br />not previously been developed for urban use
<br />and that will, when developed, generate
<br />sales or use tax pursuant to Revenue and
<br />Taxation Code Section 7200 et seq., unless
<br />the principal permitted use of the develop-
<br />ment is office, hotel, manufacturing, or in-
<br />dustrial.
<br />3. A development or business, either
<br />directly or indirectly, for the acquisition,
<br />construction, improvement, rehabilitation, or
<br />replacement of property that is or would be
<br />used for gambling or gaming of any kind
<br />whatsoever including, but not limited to,
<br />casinos, gaming clubs, bingo operations, or
<br />any facility wherein banked or percentage
<br />games, any form of gambling device, or lot-
<br />teries, other than the California State Lot-
<br />tery, are or will be played. (Ord. 99-025 §

<br />3.20.060 Hazardous waste.
<br />The agency may take any actions that it
<br />determines are necessary and that are con-
<br />sistent with other state and federal laws to
<br />remedy or remove a release of hazardous
<br />substances on, under, or from property with-
<br />in the project area whether the agency owns
<br />that property or not, subject to provisions
<br />contained in Health and Safety Code Section
<br />33454 et seq., commonly referred to as the

<br />3.24.010 Real property disposition.
<br />The agency may, within the project area
<br />or for purposes of redevelopment, sell, lease
<br />for a period not to exceed ninety-nine (99)
<br />years, exchange, subdivide, transfer, assign,
<br />pledge, encumber by mortgage, deed of
<br />trust, or otherwise, or otherwise dispose of
<br />any real property or any interest in property.
<br />The agency is authorized to dispose of real
<br />property by negotiated lease, sale, or transfer
<br />without public bidding, but only after no-
<br />ticed public hearing.
<br />Before any of the agency's property that
<br />was acquired in whole or in part, directly or
<br />indirectly, with tax increment moneys is
<br />sold or leased for development pursuant to
<br />the plan, the sale or lease shall first be ap-
<br />proved by the city council by resolution af-
<br />ter public hearing in conformance with
<br />Health and Safety Code Section 33433.
<br />The agency shall lease or sell all real
<br />property acquired by it in the project area,
<br />except that it may transfer property to the
<br />city or other public body for any amount of
<br />consideration or without requiring any con-
<br />sideration at all.
