3.32.060 Provision of down payment <br />for peace officer's purchase <br />of principal residence. <br />The Legislature has authorized redevel- <br />opment agencies in specified counties, in- <br />cluding Alameda County, to provide the <br />down payment for a peace officers purchase <br />of a principal residence in an urban neigh- <br />borhood. <br />The following definitions shall control <br />the construction of this section: <br />"Crimes" means those crimes reported in <br />the California Crime Index prepared by the <br />Department of Justice. <br />"Peace officer" means a peace officer as <br />defined in Section 830 of the Penal Code <br />who is employed by the city and whose in- <br />come at the time of the purchase does not <br />exceed one hundred twenty percent (120%) <br />of the area median income, adjusted for fam- <br />ily size pursuant to Health and Safety Code <br />50093. <br />"Urban neighborhood" means territory <br />within the project area that is all or a portion <br />of a census tract designated by the agency, <br />after consulting with the city's law enforce- <br />ment officials, where the number of crimes <br />per capita in the census tract over the last <br />year is at least ten percent (10%) greater <br />than the number of crimes per capita count- <br />ywide, over the last year. <br />From the low- and moderate -income <br />housing fund or any other source, the agency <br />may provide up to one hundred percent <br />(100%) of the down payment for the pur- <br />chase of a principal residence by a peace <br />officer in an urban neighborhood. The down <br />payment shall not exceed twenty percent <br />(20%) of the purchase price of the residence. <br />The peace officer shall occupy the residence <br />as his or her principal residence for at least <br />K1 GMIX11 <br />ten (10) years. If, during those ten (10%) <br />years, the peace officer ceases to be em- <br />ployed by the city or establishes another <br />principal residence, he or she shall repay the <br />agency a prorated amount of the down pay- <br />ment, based on the time remaining, subject <br />to the provisions of Health and Safety Code <br />Section 33334.21. <br />The agency may adopt any rules, regula- <br />tions, or limitations necessary to implement <br />this section. If the agency provides such <br />down payments, it shall prepare the report <br />required by Health and Safety Code Section <br />33334.21(k).
