not permitted through limits on land to be

<br />In all areas sufficient space shall be
<br />maintained between buildings to provide
<br />adequate light, air and privacy. (Ord. 99-025

<br />3.36.170 Signs.
<br />All signs shall be subject to the provi-
<br />sions of the city's zoning codes, and any
<br />applicable municipal codes, as amended
<br />from time to time. The agency is authorized
<br />to review signs in the project area for con-
<br />formity with the plan and may impose sign-
<br />age conditions different than those set forth
<br />in the zoning code. (Ord. 99-025 § 308.9,

<br />3.36.180 Utilities.
<br />The agency shall require that all utilities
<br />be placed underground when physically,
<br />legally and economically feasible. (Ord. 99-
<br />025 § 308.10, 1999)
<br />3.36.190 Incompatible uses.
<br />No use or structure that in the agency's
<br />determination would, because of appear-
<br />ance, traffic, smoke, glare, noise, odor, or
<br />similar factors, be incompatible with the
<br />surrounding uses or structures shall be per-
<br />mitted in any part of the project area. (Ord.
<br />99-025 § 308.11, 1999)
<br />3.36.200 Subdivision of parcels.
<br />No parcels in the project area shall be
<br />consolidated, subdivided or re -subdivided
<br />without the agency's approval. The agency
<br />shall establish reasonable procedures and
<br />requirements for obtaining such approval.

<br />3.36.210 Minor variations.
<br />The agency is authorized to permit minor
<br />variations from the limits, restrictions,
<br />standards, and controls established pursuant
<br />to the plan. In authorizing such variations,
<br />the agency shall consider whether:
<br />A. The application of certain limits, re-
<br />strictions, standards, or controls would result
<br />in practical difficulties or unnecessary hard-
<br />ships inconsistent with the general purpose
<br />and intent of the plan.
<br />B. There are exceptional circumstances
<br />or conditions relating to the property or the
<br />planned development that are not generally
<br />shared with other properties subject to the
<br />same limits, restrictions, standards, and con-
<br />trols.
<br />C. The variation sought will not create a
<br />material detriment to the public welfare or
<br />injure property or improvements in the area.
<br />D. The variation sought will not be con-
<br />trary to the plan's objectives.
<br />In granting such variation, the agency
<br />shall impose such conditions as are neces-
<br />sary to protect the public health, safety, or
<br />welfare, and to assure compliance with the
<br />purposes of the plan. Any variation permit-
<br />ted by the agency shall not supersede any
<br />other approval required pursuant to city
<br />codes and ordinances. (Ord. 99-025 §

<br />3.36.220 Design guidelines.
<br />The agency is authorized to establish
<br />guidelines and standards for, among other
<br />things, building heights, site coverage, set-
<br />backs, landscaping, building design, sign-
<br />age, circulation, screening of activities from
<br />the view of adjacent properties or the public
<br />right-of-way, and parking, which are differ-
<br />ent than the generally applicable codes and
<br />regulations, upon a finding that such guide -
