(Plaza 1 redev. plan § 11(D), 1986) <br />1.20.050 Alternate provisions on <br />failure of owner to <br />participate. <br />In the event of failure of the owner to <br />participate in accordance with the owner <br />participation provisions of this plan, the re- <br />development agency may acquire the prop- <br />erty through eminent domain or as otherwise <br />provided in any owner participation agree- <br />ment for subsequent disposition for renova- <br />tion according to standards established by <br />this plan and use in accordance with this <br />plan. This alternate procedure will become <br />effective only if the owner fails to make re- <br />quired improvements or enter into an owner <br />participation agreement within a period of <br />six months following termination of an ex- <br />isting lease, tenancy or use. The agency <br />may, on its own motion or by application of <br />the owner, extend this period for an addi- <br />tional period or periods of six months. Exe- <br />cution of an owner participation agreement <br />prior to actual acquisition by the agency, and <br />reimbursement to the agency by the owner <br />of any costs incurred in pursuance of such <br />acquisition under this alternate procedure, <br />will reinstate the owner participation provi- <br />sions of the plan.
