oped or constructed for rental or sale to per- <br />sons and families of low or moderate in- <br />come, an equal number of replacement <br />dwelling units at affordable housing costs. <br />The provisions of this section of the plan <br />apply only to Areas 2, 3, 4 and 5 of the pro- <br />ject area. <br />The agency, at its discretion, may elect to <br />make the provisions of this section applica- <br />ble to all or of the project area. (Plaza 2 re- <br />dev. plan § 6, 1988) <br />1.24.060 Conformance with general <br />plan. <br />This redevelopment plan is consistent <br />with the general plan of the city of San <br />Leandro and will protect and promote sound <br />development of a blighted area in conform- <br />ance with the provisions of said general <br />plan. This plan provides for the implementa- <br />tion of those sections of the general plan <br />dealing with circulation, open space and <br />land use within the project area. (Plaza 2 <br />redev. plan § 7, 1988) <br />1.24.070 Nondiscrimination. <br />Every deed, lease, or contract for the <br />sale, lease, sublease or other transfer of land <br />to which the agency is a party in the rede- <br />velopment project area shall contain the <br />nondiscrimination clauses prescribed by the <br />California Community Redevelopment Law. <br />(Plaza 2 redev. plan § 8, 1988) <br />1.24.080 Relocation. <br />Residences and businesses displaced <br />from locations in the Plaza 2 project area, <br />where such displacements are caused by <br />activities of the agency to implement this <br />plan, will be assisted in accordance with the <br />provisions of the California Uniform Relo- <br />cation Assistance Act and the guidelines <br />"KA <br />therefor as adopted by the redevelopment <br />agency. (Plaza 2 redev. plan § 9, 1988) <br />1.24.090 Miscellaneous. <br />A. Acquisition of Property. The agency <br />may acquire by gift, purchase, lease or the <br />real property in the project area. <br />It is in the public interest and is necessary <br />in order to eliminate the conditions requiring <br />redevelopment, and in order to execute the <br />plan, for the power of eminent domain to be <br />employed by the agency to acquire real <br />property in the project area. <br />Any eminent domain proceedings to ac- <br />quire property within the project area shall <br />be commenced not later than July 5, 2009. <br />Such time limitation may be extended only <br />by amendment to this plan. <br />The agency is not authorized by law to <br />acquire real property owned by public bod- <br />ies which do not consent to such acquisition. <br />The agency is authorized, however, to ac- <br />quire public property if it becomes private <br />property by being transferred by deed, lease <br />or otherwise to private ownership or control <br />before the agency completes land disposi- <br />tion within the entire project area if the <br />agency and the private owner do not enter <br />into a participation agreement. <br />Except as provided herein, the agency <br />shall not acquire real property to be retained <br />by an owner pursuant to a participation <br />agreement if the owner fully performs under <br />the agreement. The agency is authorized to <br />acquire structures without acquiring the land <br />upon which those structures are located. The <br />agency is also authorized to acquire any oth- <br />er interest in real property less than a fee. <br />The agency shall not acquire real proper- <br />ty on which an existing building is to be <br />continued on its present site and in its pre- <br />sent form and use without the consent of the <br />27 (San Leandro Redevelopment Agency Supp. No. 2, 12-05) <br />
