2.28.120 <br />rights-of-way, the public grounds, the space <br />around buildings, and all other outdoor areas <br />not permitted through limits on land covered <br />by this plan to be covered by buildings. <br />(Ord. 93-012 § 512, 1993) <br />2.28.120 Land coverage. <br />Land coverage by structures in the pro- <br />ject area shall not exceed the land coverage <br />permitted by the city's or county's develop- <br />ment codes, as amended from time to time. <br />(Ord. 93-012 § 513, 1993) <br />2.28.130 Light, air and privacy. <br />In all areas sufficient space shall be <br />maintained between buildings to provide <br />adequate light, air and privacy. (Ord. 93-012 <br />§ 514, 1993) <br />2.28.140 Signs. <br />All signs shall be subject to the provi- <br />sions of the city's or county's development <br />codes, and applicable municipal or county <br />codes, as amended from time to time. (Ord. <br />93-012 § 515, 1993) <br />2.28.150 Utilities. <br />The agency shall require that all utilities <br />be placed underground when physically, <br />legally and economically feasible. (Ord. 93- <br />012 §516,1993) <br />2.28.160 Incompatible uses. <br />No use or structure which by reason of <br />appearance, traffic, smoke, glare, noise, <br />odor, or similar factors which would be in- <br />compatible with the surrounding areas or <br />structures shall be permitted in any part of <br />the project area. The agency, as with all oth- <br />er elements of development, will coordinate <br />with the county in the unincorporated areas <br />of the project. (Ord. 93-012 § 517, 1993) <br />(San Leandro Redevelopment Agency Supp. No. 2, 12-05) 80 <br />2.28.170 Nondiscrimination and <br />nonsegregation. <br />There shall be no discrimination or seg- <br />regation based upon race, color, creed, sex, <br />marital status. religion, national origin, or <br />ancestry permitted in the sale, lease, sub- <br />lease, transfer, use, occupancy, tenure, or <br />enjoyment of property in the project area. <br />(Ord. 93-012 § 518, 1993) <br />2.28.180 Minor variations. <br />A. The agency board is authorized to <br />permit minor variations from the limits, re- <br />strictions and controls established by this <br />plan. In order to permit such variation, the <br />agency must determine that: <br />1. The application of certain provisions <br />of this plan would result in practical difficul- <br />ties or unnecessary hardships inconsistent <br />with the general purpose and intent of this <br />plan. <br />2. There are exceptional circumstances <br />or conditions applicable to the property or to <br />the intended development of the property <br />which do not apply generally to other prop- <br />erties having the same standards, restrictions <br />and controls. <br />3. Permitting a variation will not be <br />materially detrimental to the public welfare <br />or injurious to property or improvements in <br />the area. <br />4. Permitting a variation will not be <br />contrary to the objectives of this plan or of <br />the general plans of the city or county as <br />may be applicable. <br />B. In permitting any such variation, the <br />agency shall impose such conditions as are <br />necessary to protect the public health, safety, <br />and welfare, and to assure compliance with <br />the purpose of this plan.
