mi l/L BOARD OF PORT COMMISSIONERS CITY OF OAKLAND RESOLUTION NO. 20470 RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF SETTLEMENT AGREEMENT WITH THE CITY OF SAN LEANDRO. RESOLVED that the Board of Port Commissioners hereby finds and determines that it is in the best interests of the Port to compromise and settle litigation with the City of San Leandro in those certain actions filed in Alameda County Superior Court, entitled City of San Leandro, et al. v. Port Department of Oakland acting by and through the Oakland Board of Port Commissioners, Action No. 793033- 9.and.City of San Leandro v. Port Department of Oakland acting by and through the Oakland Board of Port Commissioners, Action No. 815053 -8, in accordance with that certain proposed Settlement Agreement dated as of November 7, 2000, on file with the Secretary of the Board, and hereby approves and authorizes the Executive Director to sign said Settlement Agreement and the Executive Director and the Port Attorney to take all necessary actions to carry out the Settlement Agreement on behalf of the Port. li IIi At a regular meeting held November 21, 2000 Passed by the following vote: Ayes: Commissioners Ayers - Johnson, Kiang, Protopappas, Scates, Tagami, Uribe and President Kramer - 7 Noes: None Absent: None 30356
