Board of Port Commissioners CONFIDENTIAL: ATTORNEY' <br />of the City of Oakland CLIENT AND ATTORNEY WORK- <br />Oakland, California PRODUCT PRIVILEGED; <br />November 3, 2000 EXEMPT FROM DISCLOSURE <br />Page 2 ABSOLUTELY PROHIBITED FROM <br />DISSEFIINATION OUTSIDE PORT <br />1. <br />Summary of Settlement Agreement <br />The Settlement Agreement is consistent with the' summary <br />provided to the Board in our October 20, 2000, letter. A copy of <br />the October 20 letter is enclosed. The major provisions of the <br />Settlement Agreement are the following: <br />The Port will fund a program to insulate up to 200 <br />residential units in San Leandro at a cost of approximately 5 <br />million. <br />The Port will fund insulation of a City branch library if a <br />Port sound study shows insulation is required. <br />The Port will fund a program to insulate up to approximately <br />400 more residential units in San Leandro Davis West and Timothy <br />Lane neighborhoods), at a cost of approximately 10 million, if <br />the Port in the future elects to change the North Field Runway <br />Policy and the change results in adverse noise impacts on San <br />Leandro residents. <br />The Port's Aviation Committee and a Subcommittee of the San <br />Leandro City Council will hold tri- annual work sessions at <br />Aviation Committee meetings. <br />Port Obligations except for certain safety meetings. and a <br />safety report) commence only after all litigation challenging the <br />ADP is finally resolved and the Port receives all permits <br />necessary for all components of9 the ADP.City obligations, <br />including dismissal of all litigation, commence as soon as the <br />Settlement Agreement is signed. <br />2. <br />Recommendation <br />The proposed Settlement Agreement will resolve all issues. <br />raised by San Leandro, but will not resolve the pending litigation <br />by the City of Alameda, CLASS or Berkeley Keep Jets Over the Bay <br />KJOB ").Almost all Port obligations under the Settlement <br />Agreement are conditioned on the Alameda, CLASS and KJOB <br />litigation being resolved and all permits being issued to develop <br />the Airport as proposed in the ADP. <br />30355
