This Attachment 1 incorporates the requirements of Public Contract Code (PCC) Section 10115 which stipulates that all state agencies must award at least 3 percent of their total annual contract Contact the dollars to subcontractors/suppliers that are certified as disabled veteran business enterprises. This Contracting Official responsible for requirement a pp lies to a state agency's overall contractin g p ro gram;therefore,state agencies have this Solicitation. the discretion to incorporate the Disabled Veteran Business Enterprise (DVBE) Participation Program requirement in individual contracts. When the goal is applied to an individual contract.as a condition for a bidder to be considered for the award of the contract,the bidder is required to meet one of the following: 1. Commit to awarding at least 3 percent of the total value of the contract to a certified DVBE or certified DVBEs. If the bidder is a certified DVBE, the bidder must commit to using its resources alone or in combination with another certified DVBE or other certified DVBEs to perform work amounting to at least 3 percent of the total contract value. 2. Demonstrate through verifiable, documented evidence that the bidder made a '`Good Faith Effort," as described beginning on Page 3 of this Attachment 1, to perform the outreach necessary to identify, solicit and fairly consider potential certified DVBE subcontractors/suppliers. 3. Submit with the solicitation response (i.e., bid, quotation or proposal) a "Notice of Approved Business Utilization Plan." By inclusion of this Attachment 1 in this solicitation, the DVBE Participation Program re- quirements are hereby incorporated and shall be incorporated in any contract that may result from this solicitation. This Attachment 1 specifies DVBE Participation Program requirements and establishes bidder responsibilities with respect to compliance with the requirements. In order to be considered as responsive to this solicitation,your firm's solicitation response must comply fully with the provisions of this Attachment 1. Failure to submit a complete response to this Attachment 1 may result in a determination that your firm's solicitation response is non-responsive, in which it will be rejected. Read this Attachment l carefully and complete fully the applicable pages of Exhibit A to this Attachment 1.
