not responsible,the City Engineer, or designee, shall notify that <br /> potential bidder in writing of the finding of non-responsibility. <br /> b) Within three days following such notification,the potential bidder <br /> shall be entitled to request an administrative hearing before the City <br /> Manager, or designee. At that hearing, the City Engineer, or <br /> designee, shall be entitled to first present evidence supporting his or <br /> her determination. The potential bidder shall be entitled to respond <br /> by presenting any evidence as to why that potential bidder is a <br /> responsible bidder as defined in Public Contract Code Section 20162. <br /> All evidence shall be taken in a manner customary to such <br /> adjudicatory proceedings of the City. <br /> c) The City Manager, or designee, in his or her discretion, shall make a <br /> finding and determination as to the responsibility of the potential <br /> bidder. The determination of the City Manager or designee shall be <br /> final and conclusive as to all disputed matters of fact and law. The <br /> City Council shall thereafter approve the list of responsible bidders. <br /> d) Judicial relief from any determination of non-responsibility may be <br /> obtained solely and exclusively by filing a Petition for Writ of <br /> Mandamus pursuant to Code of Civil Procedure Section 1094.5 no <br /> later than fifteen days from the date the City Council approves the list <br /> of responsible bidders. <br /> Introduced by Council Member Gal van and passed and adopted this <br /> 1St day of February 1999, by the following called vote: <br />
