IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 99 -73 (2167/2781) <br /> A RESOLUTION INTERPRETING THE DEFINITION <br /> OF "FAMILY" IN THE SAN LEANDRO ZONING CODE <br /> TO INCLUDE A "SAFE HOUSE" <br /> RECITALS <br /> WHEREAS, the San Leandro Zoning Code currently contains the following <br /> definition of"family": "An individual or two or more persons living together in a <br /> dwelling unit as a single housekeeping unit and in compliance with the provisions of <br /> the California Uniform Housing Code." <br /> WHEREAS, the San Leandro Zoning Code currently contains the following <br /> definition of group residential: "Shared living quarters without separate kitchen and <br /> bathroom facilities for each room or unit. This classification includes rooming or <br /> boarding houses, private residential clubs, congregate care facilities for the elderly or <br /> handicapped, and shelters for the homeless, but excludes residential hotels or motels." <br /> WHEREAS, group residential uses are not permitted in single-family <br /> residential zoning districts in the City of San Leandro. <br /> WHEREAS, a domestic violence safe house is a house that meets all of the <br /> following characteristics: <br /> 1. exclusively houses survivors of domestic violence and their children <br /> who live together as a single housekeeping unit; <br /> 2. houses individuals who have been accepted into a program which <br /> counteracts the impact of domestic violence and receives federal, state or City of San <br /> Leandro funding; <br /> 3. houses members of a program which institutes and enforces a strict <br /> confidentiality program that includes requiring all residents and program staff to sign <br /> confidentiality agreements regarding the location, maintains unpublished phone <br /> numbers and addresses, prohibits mail delivery at the location, and limits or prohibits <br /> visits from family and friends of the residents; and <br /> 1 <br />
