WORKING DRAFT FOR HCD REVIEW <br /> <br /> <br />EVALUATION OF 2010 ELEMENT 2-25 SAN LEANDRO HOUSING ELEMENT <br />Action Summary Progress <br />56.07- <br />A <br />Maintain a Rent Review Board (RRB) to <br />mediate disputes related to significant rent <br />increases in local apartment complexes. <br />Measures to strengthen RRB’s role should be <br />considered. These include: (a) Increasing <br />public awareness of the RRB, including multi- <br />lingual and tenants’ rights; (b) Reducing the <br />dollar threshold required to qualify for an <br />appeal; (c) Increasing the maximum time <br />window for requesting a hearing (renters <br />currently have 10 days from notification to <br />make that request). The City should also <br />continue providing an annual status report on <br />RRB activities, along with suggested policy and <br />program changes. <br />ADVANCE. The City continues to have an RRB that <br />meets to mediate rent increases and tenant-landlord <br />dispute. ECHO Housing now administers the Rent <br />Review Program. The RRB is funded through the <br />General Fund. The City periodically evaluates the <br />roles and responsibilities of the RRB to ensure that it is <br />as effective as possible. The cases considered by the <br />Board tend to vary based on market conditions. With <br />respect to the points at left: (a) the City has continued <br />to provide information about the RRB on its website, <br />including Spanish and Chinese translations. ECHO <br />Housing provides additional outreach on the program; <br />(b) The dollar threshold remains $75. Based on <br />feedback from the RRB in 2014, this is an appropriate <br />amount; (c) The time window is currently 15 days, not <br />10 days. This is considered sufficient based on <br />feedback from the RRB; (d) The City has continued to <br />prepare a status report on RRB activities. <br />56.07- <br />B <br />Consider a Just Cause For Eviction ordinance <br />which limits the eviction of residential tenants <br />to specified causes, and which provides <br />remedies in such cases. <br />REVISE. Based on feedback from the Rent Review <br />Board, this program should be re-worded into a broader <br />anti-displacement program. The distinction between <br />“eviction” and “notice to vacate” should be clarified. <br />The Rent Review Board also raised the issue of rent <br />increases associated with apartment improvements, and <br />the amount that could reasonably be passed along to <br />tenants. A program on this issue could be considered in <br />the future. <br />56.08- <br />A <br />Undertake a mobile home park rehabilitation, <br />safety, and affordability preservation progra m. <br />The program should beautify one or more San <br />Leandro mobile home parks and be structured <br />to avoid the dislocation of—or creation of <br />economic hardships for—mobile home park <br />occupants. In selecting a mobile home park for <br />upgrading, the focus should be on those located <br />away from East 14th Street, since the City’s <br />long term goal on that corridor is to replace <br />such uses with higher density mixed use. <br />DELETE. The City was not able to rehabilitate an <br />entire mobile home park during 2007-2014 due to <br />limited resources. Moreover, with the end of the <br />Redevelopment Agency, the feasibility of such a <br />program is dubious unless state or federal funding <br />becomes available specifically for this purpose. In the <br />meantime, the City will retain a mobile home repair <br />grant program for low income and senior occupants of <br />mobile homes in the City’s existing mobile home <br />parks. <br />56.08- <br />B <br />Continue local financial support for the Mobile <br />Home Grant Program, which provides grants to <br />very low income mobile home owners for <br />mobile home rehabilitation. Explore the <br />feasibility of expanding this program in <br />conjunction with Action 56.08-A to enable <br />more substantial upgrades to mobile homes. <br />ADVANCE. This program continues to be sustained, <br />even in the absence of funding from the former <br />Redevelopment Agency. A combination of General <br />Fund and CDBG revenues is being used. Additional <br />funding sources should be explored. <br />56.08- <br />C <br />Consider adopting a mobile home rent <br />stabilization ordinance similar to the agreement <br />currently in effect for Mission Bay. The <br />agreement would apply more broadly to <br />residents of all mobile home parks in the city <br />and help protect the city’s existing supply of <br />mobile homes. <br />ADVANCE. Mission Bay should continue to be <br />recognized as an important affordable housing resource <br />for seniors in the City. The idea of mobile home rent <br />stabilization at other mobile home parks should <br />continue to be explored. <br />
