(1) A responsible corporate officer as defined in 40 CFR 40312(6)(1) <br />403.12(1)(1); <br />(2) A general partner or proprietor of a partnership or sole <br />proprietorship, respectively, as provided in 40 CFR 403.12(1)(2); <br />(3) A duly authorized representative of the individual designated above <br />in (1) or (2), if ci ioh representative is respeesponsible for the overall operation of the <br />fanilities from which the disnharge originates subject to the requirements of 40CFR <br />403.12(1)(3)&(4). <br />(d) Beneficial Uses. Beneficial Uses shall mean uses of the Waters of the <br />State that may he protester) against quality degradation including, but not none n <br />limited to, domestic, municipal, agricultural and industrial supply, power generation, <br />recreation, aesthetic enjoyment, navigation and the preservation and enhancement of <br />fish, wildlife and other aquatic resources or reserves, and other uses, both tangible or <br />intangible as specified by in Federal or State law. <br />Best Management Practices (BMPs). Schedules of activities, prohibitions of <br />practices, maintenance procedures, and other management practices to <br />implement the prohibitions listed in 40 CFR 403.5(a)(1) and (b). BMPs also include <br />treatment requirements, operating procedures, and practices to control site <br />runoff, spillage or leaks, sludge or waste disposal, or drainage from raw materials <br />storage. <br />(e) Biochemical Oxygen Demand (BOD). Biochemical Oxygen Demand <br />(BOD) shall mean the quantity of oxygen demanded in the biochemical oxidation of <br />organic matter under standard laboratory procedure, five (5) days at twenty (20) <br />degrees centigrade expressed in terms of GenGentration of milligrams per liter (mg/l <br />(f) -Building Sewer. Building Sewer shall mean ager the piping conveying <br />wastewater from the premises of a User to the City ^fof var.Leapindfiro sanitary sewer <br />system. See Sewer Lateral, Private Sewer Lateral. <br />(g) Categorical Pretreatment Standard. Categorical Pretreatment Standard <br />shall mean any regulation containing pollutant discharge limits promulgated by EPA in <br />accordance with § 307(b) and (c) of the Act that apply to a specific category of users <br />and that appear in 40 CFR Chapter I, Subchapter N, Parts 405-471. <br />(h)City. City shall mean the City of San Leandro. <br />City Manager. City Manager shall mean the individual appointed by the <br />City of can Lea governing body (City Council) with responsibility and authority for <br />all functions of local government.
