CONDITIONS OF APPROVAL <br /> PLN2014-00060 <br /> 999 Beecher Street <br /> Steven C.Ho, Pacific Gate Inc. (Applicant) and John Kienoski(Property Owner) <br /> COMPLIANCE WITH APPROVED PLANS <br /> A. The applicant shall comply with Exhibits A and B, dated February 5, 2015, except as <br /> hereinafter modified. (Exhibits are on file at the City of San Leandro Community <br /> Development Department, 835 East 14th Street, San Leandro, California). <br /> Exhibit A— Site Plan <br /> Exhibit B—Floor Plan and Front Building Elevation with Wall Sign <br /> B. The property owner and/or applicant shall be responsible for assuring that any successor <br /> in interest who assumes responsibility for this zoning approval is informed of its terms <br /> and conditions. <br /> C. Construction or building modifications to comply with Building and Fire Codes shall <br /> commence within one (1) year following Board of Zoning Adjustments approval of the <br /> Conditional Use Permit and shall be substantially completed one year after <br /> commencement of construction. For the purpose of compliance with this condition, <br /> construction or building modifications shall be defined as the implementation of interior <br /> tenant improvements. Pursuant to Zoning Code Section 5-2218, this approval shall lapse <br /> on February 5, 2016 unless a) a building permit has been issued, coupled with diligent <br /> progress evidencing a good faith intent to commence the intended use, or b) a written <br /> request for a one-year extension of the use permit is approved by the Zoning Enforcement <br /> Official. <br /> II. PERMITTED USE <br /> A. This conditional use approval is to operate a retail furniture store at 999 Beecher Street. <br /> Said retail furniture store shall be limited to approximately 9,900 square feet (8,500 <br /> square foot showroom, 1,200 square foot office, 200 square foot electrical room) per <br /> Exhibit B. The remaining 7,700 square feet in the east end of the building shall be used <br /> for warehouse storage. Alameda County Assessor's Parcel Number 77A-675-4-20. <br /> B. The retail furniture store may be open weekdays from 9:00 a.m. to 7:00 p.m. and <br /> weekends from 10:00 a.m. to 6:00 p.m. Any expansion of these specified hours shall be <br /> requested in writing to the Community Development Director, who may approve the <br /> request or direct the matter to the Board of Zoning Adjustments. <br /> C. All furniture display, storage and any related activities shall take place inside the <br /> building. There shall not be any activities related to the furniture store or furniture <br /> warehouse outside the building, which includes but is not limited to the display and <br /> storage of furniture at the roll-up door locations or the parking and display of delivery <br /> truck(s) along the parking area parallel to Beecher Street or the parking Any exception to <br /> Agreement to Conditions February 5,2015 <br /> PLN2014-00060 Page 3 of 7 <br />
