COMMUNITY WORKFORCE AGREEMENT <br /> For the City of San Leandro <br /> This Agreement is made and entered into this day of , by and <br /> between the City of San Leandro ("City") together with contractors and sub-contractors of all <br /> tiers, who shall become parties to this Agreement by signing the "Agreement to be Bound" <br /> (Attachment A), and the Alameda County Building & Construction Trades Council and its <br /> affiliated local Unions who have executed this Agreement. <br /> PURPOSE <br /> The purpose of this Agreement is to support the efforts of the City to increase <br /> employment opportunities for workers who reside in San Leandro, to help increase training <br /> and employment opportunities for the City's students in the construction trades through <br /> apprenticeship and pre-apprentice programs as the students graduate from the City's schools, <br /> to promote efficiency of construction operations performed for and within the City of San <br /> Leandro and to provide for peaceful settlement of labor disputes and grievances without <br /> strikes or lockouts, thereby promoting the public interest in assuring the timely and economical <br /> completion of the projects. <br /> RECITALS <br /> WHEREAS, the successful completion of the City's construction projects is of the <br /> utmost importance to the City of San Leandro; and <br /> WHEREAS, the interests of the general public, the City, the Unions and Contractor(s) <br /> would be best served if the construction work proceeded in an orderly manner without <br /> disruption because of strikes, sympathy strikes, work stoppages, picketing, lockouts, <br /> slowdowns or other interferences with work; and <br /> WHEREAS, the Contractor(s) and the Unions desire to mutually establish and stabilize <br /> wages, hours and working conditions for the workers employed on construction work for and <br /> within the City of San Leandro by the Contractor(s), and further, to encourage close <br /> cooperation among the Contractor(s) and the Union(s) to the end that a satisfactory, <br /> continuous and harmonious relationship will exist among the parties to this Agreement; and <br /> WHEREAS, the parties agree that one of the primary purposes of this Agreement is to <br /> avoid the tensions that might arise on the Project if Union and non-union workers of different <br /> employers were to work side by side on the Project, thereby leading to labor disputes that <br /> could delay completion of the Project; and <br /> WHEREAS, this Agreement is not intended to replace, interfere with, abrogate, diminish <br /> or modify existing local or national collective bargaining agreements in effect during the <br /> duration of the Project, insofar as a legally binding agreement exists between the <br /> Contractor(s)/Employer(s) and the affected Union(s), except to the extent that the provisions of <br /> this Agreement are inconsistent with said collective bargaining agreements, in which event, <br /> the provisions of this Agreement shall prevail; and <br /> WHEREAS, contracts for construction work within the City of San Leandro will be <br /> awarded in accordance with the applicable provisions of the Charter of the City of San <br />
