x Ili IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 99-159 (1007 ) RESOLUTION OF INTENTION CALLING FOR A PUBLIC HEARING TO VACATE A PORTION OF PERALTA AVENUE FROM THE UNION PACIFIC RAILROAD/BART RIGHT-OF-WAY TO THE MOST WESTERLY END AND SETS THE PUBLIC HEARING DATE ON DECEMBER 6, 1999 Recitals The City Council of the City of San Leandro does RESOLVE as follows: That the City Council hereby elects to proceed under the provisions of Title V, Chapter 4, of the San Leandro Municipal Code of 1985. It is the intention of the City Council to vacate a portion of Peralta Avenue. Said Peralta Avenue is a public street in the City of San Leandro, Alameda, County, California, officially known and designated as such. The portion of the street so proposed to be vacated and abandoned is described in Exhibit "A", attached hereto, and made a part hereof. These proceedings are made subject to the reservation and exception, until such time as all utilities are relocated outside the area proposed to be reserved and excepted, of easement and rights-of- way to construct, maintain, operate, replace, remove, renew and enlarge sanitary sewers, storm drains and public utility services now existing in a portion of said area, more precisely described in Exhibit "A", including all necessary and convenient appurtenant structures and incidental purposes thereto, including access. Notice is hereby given that on December 6, 1999, at 7:00 p.m. in the Council Chambers of the City Council of said City, 835 East 14'h Street, San Leandro, California, any and all persons having any objections to the proposed vacation may appear before said Council and show cause why said proposed vacation should not be ordered.
