x <br />Ili IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 99-159 (1007 ) <br />RESOLUTION OF INTENTION CALLING FOR A PUBLIC HEARING TO VACATE <br />A PORTION OF PERALTA AVENUE FROM THE UNION PACIFIC RAILROAD/BART <br />RIGHT-OF-WAY TO THE MOST WESTERLY END AND <br />SETS THE PUBLIC HEARING DATE ON DECEMBER 6, 1999 <br />Recitals <br />The City Council of the City of San Leandro does RESOLVE as follows: <br />That the City Council hereby elects to proceed under the provisions of Title V, Chapter 4, of the <br />San Leandro Municipal Code of 1985. <br />It is the intention of the City Council to vacate a portion of Peralta Avenue. Said Peralta Avenue <br />is a public street in the City of San Leandro, Alameda, County, California, officially known and <br />designated as such. The portion of the street so proposed to be vacated and abandoned is described in <br />Exhibit "A", attached hereto, and made a part hereof. <br />These proceedings are made subject to the reservation and exception, until such time as all <br />utilities are relocated outside the area proposed to be reserved and excepted, of easement and rights-of- <br />way to construct, maintain, operate, replace, remove, renew and enlarge sanitary sewers, storm drains <br />and public utility services now existing in a portion of said area, more precisely described in Exhibit <br />"A", including all necessary and convenient appurtenant structures and incidental purposes thereto, <br />including access. <br />Notice is hereby given that on December 6, 1999, at 7:00 p.m. in the Council Chambers of the <br />City Council of said City, 835 East 14'h Street, San Leandro, California, any and all persons having any <br />objections to the proposed vacation may appear before said Council and show cause why said proposed <br />vacation should not be ordered. <br />
