'G. No facility shall occupy a required front or corner side yard. <br /> H. Noise levels shall not exceed sixty decibels (60 dBA) as measured at the property line of an R <br /> district or otherwise shall not exceed seventy decibels(70 dBA). <br /> I. The site of the facility shall be kept free of litter and any other undesirable material. Containers <br /> shall be clearly marked to identify the type of material that they contain. A notice stating that no <br /> material shall be left outside the recycling containers shall be displayed. <br /> J. Sign requirements shall be those provided for the zoning district in which the facility is located. In <br /> addition, each facility shall be clearly marked with the name and phone number of the facility <br /> operator and the hours of operation. <br /> K. No dust, fumes, smoke vibration or odor above ambient level may be detectable on neighboring <br /> properties. <br /> III. ENGINEERING AND TRANSPORTATION DEPARTMENT REQUIREMENTS <br /> A. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the City <br /> HEREBY NOTIFIES the applicant for this Project that the 90-day approval period (in which the <br /> applicant may protest the imposition of any fees, dedications, reservations, or other exactions <br /> imposed on this Project by these Conditions of Approval) will begin on the date of the <br /> conditional approval of this Project. If you fail to file a protest within this 90-day period, <br /> complying with all of the requirements of Government Code Section 66020, you will be legally <br /> barred from later challenging any such fees, dedications, reservations or other exactions. <br /> B. The proposed development shall comply with City ordinances, policies and regulations. All <br /> improvements shall be in accordance with the City's Design Standards, Specifications and <br /> Standard Plans unless otherwise specifically approved by the City Engineer. <br /> C. Applicant shall pay design review fees, permit fees, inspection fees, sewer connection fees, and <br /> any other fees charged by the City or other reviewing agencies for the review, approval, <br /> permitting and inspection of the public and/or private improvements. <br /> D. Applicant shall remove any unused driveways or damaged driveways, sidewalk, and curb and <br /> gutter along the full property frontage and shall construct new City standard driveway, sidewalk, <br /> curb and gutter in place of the removed items. <br /> E. Applicant shall obtain an Encroachment Permit from the Engineering and Transportation <br /> Department and pay encroachment permit fees for any work within the public right-of-way prior <br /> to the issuance of building permits for the project. <br /> F. Applicant shall comply with the regulations and provisions contained in the City's Grading <br /> Ordinance, the City's Municipal Regional Storm Water Permit, to the satisfaction of the City <br /> Engineer. <br /> Agreement to Conditions April 30,2015 <br /> PLN 15-0006 Page 4 of 7 <br />
