IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> RESOLUTION NO. 2015-190 <br /> RESOLUTION AUTHORIZING THE CITY MANAGER TO AMEND THE <br /> EMPLOYMENT AGREEMENT FOR THE POLICE CHIEF SANDRA SPAGNOLI IN <br /> REGARDS TO EMPLOYER PAID MEMBER CONTRIBUTIONS (EPMC) <br /> RETIREMENT BENEFITS TO COMPLY WITH CALPERS REGULATIONS <br /> WHEREAS, due to an audit conducted by the California Public Employees' Retirement <br /> System(Ca1PERS)the Police Chief Agreement for Employment must be amended; <br /> WHEREAS, Ca1PERS recommends that the Police Chief should be grouped with the San <br /> Leandro Police Management Unit(SLPMU) as the closest related safety group for the purposes <br /> of Employer Paid Member Contributions (EPMC)retirement benefits; <br /> WHEREAS,the Police Chief would receive the same EPMC as specified in the SLPMU <br /> Memorandum of Understanding for the period January 1, 2013 through July 30, 2015; <br /> WHEREAS,the City Council of the City of San Leandro and Police Chief Sandra <br /> Spagnoli were made aware of the Ca1PERS audit finding and recommendation to come into <br /> compliance with Ca1PERS regulations; <br /> WHEREAS,the City Manager requests City Council authorization to negotiate a credit to <br /> the Police Chief Sandra Spagnoli's EPMC schedule, and an amount not to exceed$25,000 to pay <br /> the amount necessary to ensure that the City is in compliance with the terms of the Police Chiefs <br /> current employment agreement. <br /> NOW, THEREFORE,the City Council of the City of San Leandro does RESOLVE as <br /> follows: <br /> That the City Manager is authorized to execute a Letter of Understanding to amend the <br /> Agreement for Employment with the Police Chief Sandra Spagnoli, within the following <br /> parameters: That the City shall provide to Sandra Spagnoli a credit for amounts due pursuant to <br /> the Ca1PERS audit finding, and that the City Manager may negotiate a lump sum payment or <br /> credit,not to exceed $25,000, to comply with the terms of the Police Chief's current employment <br /> agreement, as long as such payment or credit does not result in salary increases beyond those <br /> identified in the current agreement. <br /> ***** <br />
