The employee may be compensated in payment at <br />the overtime rate for the equivalent of four (4) hours, and the remaining eight (8) hours of <br />holiday time will remain in the holiday account. In the event the employee elects compensatory <br />time off the accrued time shall be placed in the employee’s compensatory time off balance, not <br />to exceed eighty (80) hours. The term “compensatory time” refers to that time earned and <br />accrued by working any overtime or holiday. <br /> <br /> For Public Safety Dispatch Supervisor, Senior Public Safety Dispatcher, Public Safety <br />Dispatcher, Senior Police Service Technician, Police Service Technician, Police Services Aide <br />or Administrative Specialist-Police employees, compensatory time may be used, and replaced, <br />without regard to frequency of use, as long as the account balance does not exceed eighty (80) <br />hours. <br /> <br /> Once a Public Safety Dispatch Supervisor, Senior Public Safety Dispatcher, Public Safety <br />Dispatcher, Senior Police Service Technician, Police Service Technician, Police Services Aide <br />or Administrative Specialist-Police employees, compensatory time off balance exceeds eighty <br />(80) hours, the employees shall be compensated in pay. <br /> <br /> A Public Safety Dispatch Supervisor, Senior Public Safety Dispatcher, Public Safety <br />Dispatcher, Senior Police Service Technician, Police Service Technician, Police Services Aide <br />or Administrative Specialist-Police employee may schedule accrued compensatory time and the <br />Department will schedule a relief employee as available. If not available, the Department will <br />post the vacancy for a volunteer employee to sign for, on an overtime basis. The volunteer <br />employee will only be compensated in pay for the overtime worked at the overtime rate of one <br />and one-half times (1½) the hourly rate based on the employee’s monthly salary. This process <br />shall be consistent with the San Leandro Police Department sign-up procedures. <br /> <br />14.1 Holiday Closure <br /> <br /> The City will notify the Union by September 1st each year if a holiday closure will occur and <br />which City functions and employees will be affected. <br /> <br />Section 15. Reallocation of Position <br /> <br /> An employee in a position reallocated to a lower class shall have the right of either; (1) <br />transferring to a vacant position in his/her present classification provided the department head <br />into which the transfer is proposed agrees; or (2) continuing in the same position in the lower <br />classification with their salary Y-rated. <br /> <br />Section 16. Injury on Duty <br /> <br /> When an employee is incapable of performing his work or duties as a result of injuries received <br />or illness arising in the course of his/her employment by the City and receives benefits pursuant <br />to the Workers' Compensation Act, upon the sole discretion of the City Manager, a full-time <br />competitive service employee hired pursuant to the merit personnel program may be granted a <br />leave with an amount of pay equal to the difference between his/her City pay and the Workers' <br />Compensation pay benefit, if any, received by him/her during such incapacity, but not to exceed <br />one (1) year for any one (1) period of such incapacity.
