Incorrect Bid Information - If the City determines that a Bidder has provided incorrect information <br />which the Bidder knew or should have known was materially incorrect, that bid shall be determined <br />non-responsive and the bid shall be rejected. <br />Review Rights - Proposals submitted may be reviewed and evaluated by any person(s) considered <br />necessary to the decision-making process at the discretion of the City. <br />Bid Preparation Costs - The City shall not pay any costs associated with the preparation, submittal, or <br />presentation of any bid. <br />Bid Alternate Services - Bids of alternate solutions, excepting the enhancements and additional value <br />components called for (i.e., bids that offer something different from that requested by the RFP), shall be <br />considered non-responsive and shall be rejected. <br />Bid of Additional Services - If a Bidder proposes an offer of services in addition to those required by and <br />described in this RFP, these additional services may be added to the contract before contract signing at <br />the sole discretion of the City. <br />Independent Price Determination - The Bidder is prohibited from submitting more than one bid. <br />However, alternative solutions within Bidder's single response will be accepted. Submittal of more than <br />one response shall result in the disqualification of the Bidder. <br />Public Release of Information - News releases, articles, brochures, advertisements, prepared speeches <br />and other information releases concerning this RFP, or any subsequent contract or activity related <br />thereto, may not be made without the prior written approval of the City. <br />Liability and Reserved Rights - The City reserves the right not to award a Contract to any of the Bidders <br />solicited in this RFP. The City also reserves the right to make partial awards. This RFP may be withdrawn <br />at any time without liability or responsibility for any damages or expenses incurred by Bidders. <br />Public Disclosure - All materials provided to the City by Bidders are subject to State and City public <br />disclosure laws. Proposals shall become the property of the City of San Leandro. Once a final award is <br />made, all bid responses, except financial and proprietary information, become a matter of public record <br />and shall be regarded by the City as public records. The City shall not in any way be liable or responsibly <br />for the disclosure of any such records or portions thereof if the disclosure is made pursuant to a request <br />under the Public Records Act. <br />INSTRUCTIONS TO BIDDERS <br />This section outlines specific instructions for proposal submission. Bidders not adhering to these <br />instructions shall be disqualified without further consideration. <br />1.15. Pre -Bid Conference <br />A Pre -Bid Conference for all potential Bidders is scheduled for Tuesday, September 15th, from 1:30-2:30 <br />PM. The conference shall be held at the Public Works Service Center, 14200 Chapman Road, San <br />RFP No. 55021— Public Works CMMS Page 10 of 46 <br />
