35 SECTION 2: MASTER AGREEMENT TERMS AND CONDITIONS | 2014_0122 <br /> <br />review of Contract Vendor’s operations, systems, records, procedures, rules, and practices in the event of a security <br />intrusion in order to validate compliance with PCIDSS. <br /> <br />24. PERFORMANCE WHILE DISPUTE IS PENDING. Notwithstanding the existence of a dispute, the parties shall <br />continue without delay to carry out all of their responsibilities under the Master Agreement that are not affected by the <br />dispute. If a party fails to continue without delay to perform its responsibilities under the Master Agreement, in the <br />accomplishment of all undisputed work, any additional cost incurred by the other parties as a result of such failure to <br />proceed shall be borne by the responsible party. <br /> <br />25. PREFERENCE. <br />Targeted/Economically Disadvantaged.In accordance with Minn. Stat. § 16C.16, subds. 6 and 7, eligible certified <br />targeted group (TG) businesses and certified economically disadvantaged (ED) businesses will receive a 6 percent <br />preference on the basis of award for this RFP. The preference is applied only to the first $500,000 of the response to <br />the RFP. Eligible TG businesses must be currently certified by the Materials Management Division prior to the bid <br />opening date and time. <br /> <br /> To verify TG/ED certification, refer to the Materials Management Division’s web site at <br />www.mmd.admin.state.mn.usunder “Vendor Information, Directory of Certified TG/ED Vendors.” <br /> <br /> To verify TG eligibility for preference, refer to the Materials Management Division’s web site under “Vendor <br />Information, Targeted Groups Eligible for Preference in State Purchasing” or call the Division’s HelpLine at <br />651.296.2600. <br /> <br />Reciprocal Preference. In accordance with Minn. Stat. §16C.06, subd 7, the acquisition of goods or services shall be <br />allowed a preference over a non-resident vendor from a state that gives or requires a preference to vendors from that <br />state, the preference shall be equal to the preference given or required by the state of the non-resident vendor. If you <br />wish to be considered a Minnesota Resident vendor you must claim that by filling out the Resident Vendor Form <br />included in this solicitation and include it in your response. <br /> <br /> Veteran. In accordance with Minn. Stat. § 16C.16, subd. 6a, (a) Except when mandated by the federal government as <br />a condition of receiving federal funds, the commissioner shall award up to a six percent preference in the amount bid <br />on state procurement to certified small businesses that are majority-owned and operated by: <br />(1) recently separated veterans who have served in active military service, at any time on or after September 11, <br />2001, and who have been discharged under honorable conditions from active service, as indicated by the <br />person's United States Department of Defense form DD-214 or by the commissioner of veterans affairs; <br />(2) veterans with service-connected disabilities, as determined at any time by the United States Department of <br />Veterans Affairs; or <br />(3) any other veteran-owned small businesses certified under section 16C.19, paragraph (d). <br /> <br />In accordance with Minn. Stat. § 16C.19 (d), a veteran-owned small business, the principal place of business of <br />which is in Minnesota, is certified if it has been verified by the United States Department of Veterans Affairs as <br />being either a veteran-owned small business or a service disabled veteran-owned small business, in accordance <br />with Public Law 109-461 and Code of Federal Regulations, title 38, part 74. <br /> <br />To receive a preference the veteran-owned small business must meet the statutory requirements above by the <br />solicitation opening date and time. The preference is applied only to the first $500,000 of the response. <br /> <br />If responder is claiming the veteran-owned preference, attach documentation, sign and return form with <br />response to the solicitation. Only eligible veteran-owned small businesses that meet the statutory requirements <br />and provide adequate documentation will be given the preference. <br /> <br />26. PUBLIC INFORMATION. Once the information contained in the responses is deemed public information, interested <br />parties may request to obtain the public information.
