RECORDING REQUESTED BY, <br />WHEN RECORDED RETURN TO: <br />DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR <br />WARREN AVENUE FOUR, A PLANNED DEVELOPMENT PROJECT <br />THIS DECLARATION is made on ,2016 by Treasureland <br />Development, LLC, a California Limited Liability Company <br />(hereinafter "Declarant"). <br />RECITALS <br />A. Declarant is the owner of that certain real property located <br />in the City of San Leandro, County of Alameda, State of <br />California, and more particularly described on Exhibit "A" <br />attached to and made a part of this Declaration ("Property"). <br />B. Declarant intends to develop the Property as a Planned <br />Development subject to the provisions of the Davis -Stirling <br />Common Interest Development Act contained in Sections 4000 <br />through 6150 of the California Civil Code, and to establish a <br />plan for planned development ownership for the benefit of all <br />the Lots created. <br />C. In furtherance of this intent, Declarant hereby declares that <br />all of the Property is and shall continue to be held, conveyed, <br />hypothecated, encumbered, leased, rented, used, occupied, and <br />improved subject to the declarations, limitations, covenants, <br />conditions, restrictions, reservations, rights, and easements <br />set forth in this Declaration, as this Declaration may be <br />amended from time to time, all of which are declared and agreed <br />to be in furtherance of a plan established for the purpose of <br />enhancing and perfecting the value, desirability, and <br />attractiveness of the Property. All provisions of this <br />Declaration shall constitute covenants running with the land and <br />enforceable equitable servitudes upon the Property, and shall be <br />1 <br />
