Alameda County, California. <br />Amendments by Owners After Close of First Sale <br />Section 9.02 At any time after the close of the first sale of a <br />Lot to a purchaser other than Declarant, this Declaration may be <br />amended by the vote or written consent of Owners representing <br />not less than seventy-five percent (75%) of the voting power of <br />the Association. An amendment becomes effective after (1) the <br />approval of the required percentage of Owners has been given, <br />(2) the fact has been certified in a writing executed and <br />acknowledged by an officer designated by the Association for <br />that purpose or, if no such designation is made, by the <br />President of the Association, and (3) that writing has been <br />recorded in Alameda County records. <br />Prior Approval of Commissioner <br />Section 9.03. When required under Business and Professions Code <br />Section 11018.7, the prior written consent of the Real Estate <br />Commissioner shall be obtained prior to submitting a proposed <br />amendment to this Declaration to the vote of the Owners. <br />ARTICLE X. GENERAL PROVISIONS <br />Term <br />Section 10.01. The provisions of this Declaration shall continue <br />in effect for a term of forty (40) years from the date of <br />execution. Thereafter, it shall be automatically extended for <br />successive periods of ten (10) years, until the membership of <br />the Association decides to terminate it. <br />Severability <br />Section 10.02. The provisions of this Declaration shall be <br />deemed independent and severable, and the invalidity or partial <br />invalidity or unenforceability of any one provision shall not <br />affect the validity or enforceability of any other provision. <br />Binding <br />Section 10.03. This Declaration, any amendment to it, and any <br />valid action or directive made pursuant to the Declaration, <br />shall be binding on the Declarant and the Owners and their <br />heirs, grantees, tenants, successors, and assigns. <br />Interpretation <br />Section 10.04. The provisions of this Declaration shall be <br />liberally construed and interpreted to effectuate its purpose of <br />creating a uniform plan for the development and operation of a <br />Planned Development project. Failure to enforce any provision of <br />this Declaration shall not constitute a waiver of the right to <br />17 <br />
