CONDITIONS OF APPROVAL <br />PLN2013-00061 <br />274 Kenilworth Avenue <br />Kent Wai Lau (Applicant and Property Owner) <br />I. COMPLIANCE WITH APPROVED PLANS <br />A. The project shall comply with Exhibits A through F, dated February 6, 2014, except as <br />hereinafter modified. (Exhibits are on file at the City of San Leandro, Community <br />Development Department, 835 East 14th Street, San Leandro, California, 94577). <br />Exhibit A — Proposed Parcel Map <br />Exhibit B — Topographic Map <br />Exhibit C — Proposed Site Plan, Project Data (A 1.1) <br />Exhibit D — Proposed Single -Family Residence Floor Plans (A 2.1) <br />Exhibit E — Proposed Elevations with Daylight Plane, Streetscape (A 3.1) <br />Exhibit F — Proposed Building Sections (A 3.2) <br />B. The developer shall be responsible for assuring that any successor in interest who <br />assumes responsibility for this zoning approval is informed of its terms and conditions. <br />C. Construction shall commence within one (1) year following Board of Zoning <br />Adjustments approval and shall be substantially completed within one (1) year <br />thereafter. For the purpose of compliance with this condition, commencement of <br />construction shall be defined as the construction of a substantial portion of the <br />garage/foundation. <br />II. PERMITTED USE <br />A. This Variance and Minor Site Plan review is an approval to subdivide an existing 9,600 <br />square -foot parcel into two parcels with 4,600 and 5,000 square feet each and 48 feet of <br />lot width, respectively, on 274 Kenilworth Avenue and the vacant lot on Myers Court <br />and to build a 2,417 square foot two-story home on the Myers Court lot with a 430 <br />square foot attached garage and a 28 square -foot porch at the vacant lot on Myers <br />Court; Alameda County Assessor's Parcel Number 76-299-39. <br />B. No application for amendment of the application or Conditions of Approval may be <br />submitted or accepted for processing by the City unless (i) there is full compliance with <br />all terms of the application and Conditions of Approval; or (ii) the Community <br />Development Director can waive compliance with the terms of the application if they are <br />minor in content <br />C. The project shall remain in substantial compliance with the approved exhibits and <br />plans. Any change to the parameters of the proposed parcel map shall be subject to the <br />review and approval of the Zoning Enforcement Official, who may administratively <br />approve or require review by the Board of Zoning Adjustments as a modification to <br />appropriate application approval listed above. <br />Agreement to Conditions February 21, 2014 <br />PLN2013-00061 Page 3 of 9 <br />
