SAN LEANDRO GENERAL PLAN UPDATE FINAL EIR <br />CITY OF SAN LEANDRO <br />COMMENTS AND RESPONSES <br />PLACEWORKS 5-21 <br />TABLE 5-1 COMMENTS AND RESPONSE MATRIX <br />Comment # Date Comment Response <br />rise.” Pages 4.14-56 - 4.14-57 references Alameda County Flood Control and Water <br />Conservation District participation with the Federal Emergency Management Agency “to <br />study the effects of sea level rise on Bay area shorelines, creeks, and levees and <br />determine what changes may be needed to provide 100-year level of flood protection.” <br />The Bay Plan policies on climate change state, in part that “[w]hen planning shoreline <br />areas or designing larger shoreline projects, a risk assessment should be prepared by a <br />qualified engineer and should be based on the estimated 100-year flood elevation that <br />takes into account the best estimates of future sea level rise and current flood <br />protection and planned flood protection that will be funded and constructed when <br />needed to provide protection for the proposed project or shoreline area. A range of sea <br />level rise projections for mid-century and end of century based on the best scientific data <br />available should be used in the risk assessment. Inundation maps used for the risk <br />assessment should be prepared under the direction of a qualified engineer. The risk <br />assessment should identify all types of potential flooding, degrees of uncertainty, <br />consequences of defense failure, and risks to existing habitat from proposed flood <br />protection devices.” An analysis of potential impacts from sea level rise should be used <br />to evaluate impacts to the San Leandro shoreline, including the proposed zoning changes <br />and preliminary components in the San Leandro Shoreline Development Project. <br />also addressed in the proposed San Leandro 2035 General Plan in the <br />Environmental Hazards Element. Policy EH-1.8 of the proposed Plan is to, "Consider <br />the effects of projected sea level rise in the design and planning of all development, <br />recreational improvements, and infrastructure along the San Leandro shoreline." <br />C01-04 Safety of Fills. On page 4.9-13, the DEIR states “Although there are no development <br />projects currently identified under the proposed (General) Plan, future development <br />could still occur along the San Leandro Shoreline under the proposed (General) Plan.” <br />However, details for a General Plan Amendment for the San Leandro Shoreline <br />Development Project, starting on page 3-128 of the proposed General Plan, identifies <br />housing units, an office campus, a banquet and conference facility, and other preliminary <br />components. Proposed development projects which require Bay fill will be subject to Bay <br />Plan Safety of Fills findings which state, in part, that “New projects on fill or near the <br />shoreline should either be set back from the edge of the shore so that the project will <br />not be subject to dynamic wave energy, be built so the bottom floor level of structures <br />will be above a 100-year flood elevation that takes future sea level rise into account for <br />the expected life of the project, be specifically designed to tolerate periodic flooding, or <br />employ other effective means of addressing the impacts of future sea level rise and <br />storm activity,” and that “adequate measures should be provided to prevent damage <br />from sea level rise and storm activity that may occur on fill or near the shoreline over the <br />expected life of a project.” General Plan Update Action LU-9.4.B: Sustainability and Sea <br />Level Rise recognizes the need for review of future projects to “Ensure that future <br />development at the shoreline takes place in an environmentally sensitive manner, taking <br />into consideration the potential effects of rising sea levels.” Further, Section 66605 of <br />the McAteer-Petris Act authorizes the place of fill in the Bay only for water-oriented uses <br />or minor fill for improving shoreline appearance or public access. <br />As described in Response C01-03, the proposed San Leandro 2035 General Plan <br />includes the existing land use designations for the Shoreline project site and a brief <br />description of anticipated future development. When areas subject to BCDC <br />jurisdiction are proposed for future development, the development will be subject <br />to all applicable BCDC regulatory requirements, including standards for bay fill and <br />preparation of sea level rise assessments. The City notes that sea level rise <br />regulation is evolving. The Shoreline EIR mitigation measures require the project to <br />prepare a sea level rise assessment (Mitigation Measure HYDRO-7); the draft San <br />Leandro 2035 General Plan includes Policy EH-1.8 to, "Consider the effects of <br />projected sea level rise in the design and planning of all development, recreational <br />improvements, and infrastructure along the San Leandro shoreline." <br />C01-05 Shoreline Protection.
