Gallery for the Curation, Installation, and <br />Maintenance of Mural Art in Four San Leandro Locations <br />WHEREAS, an agreement between the City of San Leandro and Athen B. Gallery, a <br />copy of which is attached, is presented to this City Council; and <br />WHEREAS, the City Council is familiar with the contents thereof; <br />WHEREAS, amendments to the agreement to clarify the work or respond to atypical <br />existing conditions are a normal aspect of public contracting and procurement of services; and <br />WHEREAS, in order to expedite the delivery of public projects on schedule and on <br />budget, provide that the subcontractors and workers are paid in a timely fashion, avoid as <br />much as possible costly delay claims, and ensure that the City completes projects according <br />to the City’s highest standards, the City Council finds that providing authorization to negotiate <br />and approve amendments to the consulting services agreement is in the best interest of public <br />welfare; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />That said agreement is hereby approved and execution by the City Manager <br />is hereby authorized; and <br />That the City Manager or his designee is hereby authorized to negotiate and approve <br />cumulative amendments to the agreement up to a maximum of 25% of the original contract <br />amount, or $20,000. <br />Page 1 City of San Leandro Printed on 10/11/2016
