File Number: 16-559 <br />To address major emergencies encountered during this project, staff requested and obtained <br />City Council approval to increase the contract amount. Two urgent situations were resolved <br />with this expanded contract: upsizing the deteriorated sewer main on West Juana Avenue, <br />which serves the 200-unit Marea Alta housing development, and repairing a broken sanitary <br />sewer force main line at the intersection of Merced Street and Fairway Drive. The sewer force <br />main was likely damaged during the construction of a PG&E project in 2015. The City <br />submitted a claim to PG&E for the cost of repairs by Con-Quest Contractors and the cost of <br />City staff time associated with the force main repair and clean-up efforts. <br />Current Agency Policies <br />·2015 City Council Goal: Maintain and enhance City’s infrastructure. <br />Previous Actions <br />·On July 21, 2014, the City Council by Resolution No. 2014-079 rejected all bids for the <br />subject project. <br />·On April 20, 2015, the City Council by Resolution No. 2015-083 awarded the construction <br />contract in the amount of $1,114,310.00 for the subject project to Con-Quest Contractors, <br />Inc. and appropriated an additional $279,512.00 of Water Pollution Control Enterprise <br />Funds to allow for the inclusion of the Additive Bid Item. <br />·On September 8, 2015, the City Council by Resolution No. 2015-153 authorized the City <br />Manager to negotiate and approve Contract Change Orders up to 25% for the contract <br />with Con-Quest Contractors, Inc. and also for other active construction contracts. No <br />funding appropriation was included or necessary with Resolution No. 2015-153. <br />·On April 4, 2016, the City Council by Resolution No. 2016-041 appropriated $291,510.04 <br />of Water Pollution Control Enterprise Funds and approved an increase in the contract <br />change order cap from 25% to 40% <br />·On July 18, 2016, the City Council by Resolution No. 2016-094 appropriated $313,388.84 <br />of Water Pollution Control Enterprise Funds and approved an increase in the contract <br />change order cap from 40% to 60% <br />Applicable General Plan Policies <br />·Policy 52.04: Maintain efficient, environmentally sound, and cost-effective wastewater <br />collection and treatment services in San Leandro. <br />Environmental Review <br />This project was deemed categorically exempt from the California Environmental Quality Act <br />(CEQA) per Section 15302 - Replacement or Reconstruction, Class 2. The Notice of <br />Exemption was filed with the Alameda County Recorder’s Office on July 22, 2013. <br />Summary of Public Outreach Efforts <br />This project was advertised in the Daily Review on February 26, 2015 as well as the World <br />Journal, South County Post and Vision Hispana Newspaper, the circulations of each reflecting <br />the diversity of San Leandro.
