The City Manager may establish in the Administrative Code such <br />height limitation for abatement of weeds as he deems necessary or desirable. <br />3-2-210 DECLARATION OF PUBLIC NUISANCE. <br /> Any property within the City of San Leandro maintained in violation of this Chapter is hereby declared to be a public nuisance, and such violation shall be abated in the manner provided in this Chapter 1-12. <br />3-2-215 ALTERNATIVE PROCEDURERESERVED. <br /> Nothing in this Chapter shall be deemed to prevent the City Manager from using the <br />procedures set forth in Title 4, Division 3, Article 2 of the Government Code (Section 39560 et seq.). <br />3-2-220 RESERVED. (Repealed by Ordinance No. 2002-032, 12/9/02) <br />3-2-235 ADMINISTRATIVE ENFORCEMENT OF VIOLATIONS UNDER THIS CHAPTERRESERVED. <br /> Any Enforcement Officer shall have the authority to gain compliance with all provisions <br />of this Chapter. These powers include the power to issue a notice of violation, as described <br />below in Section 3-2-240, the power to inspect public and private property, and to seek and <br />employ whatever remedies are available under this Chapter and this Municipal Code not specifically mentioned herein. <br />3-2-240 NOTICE OF VIOLATIONRESERVED. <br /> (a) Subject to subsection (e) of this section, whenever an Enforcement Officer finds <br />that a provision of this Chapter has been violated, and such officer determines to pursue <br />administrative enforcement of the violation pursuant to this Chapter, he or she shall issue the responsible party a written notice of the violation either imposing a penalty or ordering the <br />responsible party to appear at a hearing and show cause why such condition should not be abated <br />by the City at the responsibly party’s expense (“notice of violation”). Such notice of violation <br />shall be served on the responsible party in the manner described in subsection (b) of this section. <br />Under this Chapter, a maximum of two (2) notices of violation shall be issued upon a responsible party before an Enforcement Official may seek forcible abatement. The Enforcement Officer <br />shall include in the notice of violation the following information: <br /> (1) The date and location of the violation, including the address or other definite <br />description of the location where the violation occurred, or is occurring; <br /> (2) The sections of this Chapter being violated and a description of each such violation; <br />263
