46 <br />• Demonstrates interest in and understanding of the project. <br />• Is available to perform the scope of the work in a timely and professional <br />manner. <br />• Builds the diversity of the City’s public art collection. <br />• If applicable, demonstrates a cohesive team. <br />CRITERIA FOR EVALUATING ARTIST CONCEPT AND SCHEMATIC <br />PROPOSALS <br />The SLAC will use the following criteria to review Artist Concept Proposals: <br />• Clearly responds to the project goals. <br />• Meets the definition of artwork as defined by the Public Art Program <br />Ordinance. <br />• Demonstrates excellence in aesthetic quality, workmanship, innovation, <br />and creativity. <br />• Demonstrates appropriateness in scale, form and is of materials/media <br />suitable for the site. <br />• Demonstrates feasibility in terms of budget, timeline, safety, durability, <br />operation, maintenance, conservation, legal and ethical issues related to <br />possession and use of proposed artwork, security, and/or storage and <br />siting. <br />• Builds the diversity of the City’s public art collection. <br />VISUAL ARTISTS RIGHTS ACT (VARA) <br />The City needs to be aware that conducting a Public Art Program comes with <br />specific legal responsibilities as outlined in the Visual Artists Rights Act (VARA). <br />Passed by the United States Congress in 1990, VARA grants artists the rights <br />to prevent intentional modification to their art and the destruction of a work of <br />“recognized stature.” This is regardless of any subsequent physical ownership <br />of the work itself, or regardless of who holds the copyright to the work. VARA <br />covers only limited, fine art categories of works of visual art, which are defined <br />as paintings, sculptures, drawings, prints, and still photographs produced for <br />exhibition. <br />57
