60 <br />B <br />SECTION 2 - DEFINITIONS. <br />For purposes of this section, the following terms shall have the following <br />meanings: <br />A. “Artist” shall mean an individual generally recognized by critics and peers <br />as a professional practitioner of the visual, performing, media, or literary <br />arts as judged by the quality of that professional practitioner’s body of <br />work, educational background, experience, public performances, past public <br />commissions, sale of works, exhibition record, publications, and production <br />of Artwork. The members of the architectural, engineering, design, or <br />landscaping firms retained for the design and construction of a development <br />project covered by Ordinance 30-65 shall not be considered Artists for the <br />purposes of this Part. <br />B. “Arts and Culture Work Plan” shall mean a document developed annually <br />by the San Leandro Arts Commission with Public Art project and funding <br />recommendations that shall be presented to the City Council for approval. <br />C. “San Leandro Arts Commission” shall mean the City of San Leandro <br />commission that advises the City Council on arts and culture policies, <br />procedures, and expenditures from the San Leandro Cultural Arts Fund. <br />D. “Building Development Costs” shall mean those construction costs as <br />declared on all building permit applications for new construction, and as <br />accepted by the Chief Building Official, but shall not apply to costs solely <br />attributable to tenant improvements. Building permit applications shall <br />include, but not be limited to, all building, plumbing, mechanical and electrical <br />permit applications for the project. <br />E. “Cultural Arts” as defined herein shall be located in a public place on private <br />property or on land or in a building owned by the City of San Leandro and <br />encompass all cultures through the broadest possible range of expression, <br />media, and materials including: <br />1. The services of, or work by, an Artist who produces art in any <br />medium or material, including, but not limited to, the visual, <br />performing, literary and media arts that may be permanent, fixed, <br />temporary or portable, may be an integral part of a building, <br />facility, or structure, and may be integrated with the work of other <br />design professionals. <br />2. Artistic and cultural facilities such as exhibition space, performance <br />or rehearsal space, artist studio space and arts education facilities; <br />3. The provision of artistic and cultural services, including the <br />sponsorship of performing arts. <br />71
