65 <br />B <br />D. The developer may be required by staff to contract the services of a <br />professional arts consultant to oversee the arts and culture project particularly <br />if valued at fifty thousand dollars ($50,000) or more. Arts consultant fees are <br />an allowable Program Allocation budget expense. <br />SECTION 5 – CULTURAL ARTS FUND. <br />A. There is hereby created the Cultural Arts Fund to account for the Public Art <br />In-Lieu Contributions and any and all other revenues appropriated or received for <br />Arts and Culture. The revenues in such Fund shall be used solely for: <br />1. The acquisition, commission, design, installation, production, <br />presentation, performance, maintenance, and insurance of Public <br />Art and Cultural Arts. <br />2. The acquisition or improvement of real property for the purpose of <br />displaying Public Art. <br />3. Other expenses associated with implementation of Arts and <br />Culture and the Arts and Culture Work Plan. <br />4. Further the purposes of Arts and Culture as defined in this <br />Ordinance. <br />B. The Cultural Arts Fund shall be distributed annually as follows: <br />1. No more than twenty percent (20%) of the annual Cultural Arts <br />Fund shall be used for all necessary and reasonable administrative <br />costs incurred in connection with City staff supervision and control <br />of the expenditure of all funds appropriated for public art. <br />2. The balance of the Cultural Arts Fund shall be used to support <br />Public Art and Cultural Arts throughout San Leandro that may <br />take the form of site-specific Artwork commissions, purchase of <br />Artwork, grants to non-profit arts organizations and artists, arts <br />and culture events and festivals, and other special arts and culture <br />initiatives. <br />3. The Fund shall be authorized to accept gifts, grants and <br />donations made to the City of San Leandro, as well as any in- <br />lieu contributions from private development projects and tax <br />revenue designated from NN, OO, and PP. The Fund shall be self- <br />perpetuating from year to year. <br />C. If real property purchased with monies from the Cultural Arts Fund is <br />subsequently sold, the proceeds from the sale shall be returned to the Cultural <br />Arts Fund. <br />76
