<br />29. SURVIVAL <br />The provisions of Sections 20, 21, and 24 of this Lease will survive the expiration or termination <br />of this Lease. <br />30. HOLD OVER <br />Any holding over after the expiration of the Term, with the consent of Lessor, shall be construed <br />to be a tenancy from month to month. All terms and conditions of the Lease, excluding <br />Consideration shall be in full force and effect during the Hold-Over. <br />During Hold-Over, the Consideration shall increase by one hundred percent (100%) above the <br />previous year’s Consideration paid by Lessee. The full Consideration shall be due and payable <br />on the Due Date. <br />31. REMOVAL OF LESSEE’S FACILITIES UPON TERMINATION <br />In the event of the termination of this Lease by reason of the breach of this Lease by Lessee, or <br />by Lessee electing to terminate Lease, or by the expiration of this Lease, all improvements <br />constructed on the Premises shall become and remain the property of Lessor, at no cost to <br />Lessor, except as otherwise provided by this section. If Lessor decides not to retain all or a <br />portion of the buildings and improvements constructed by Lessee, upon termination of this Lease <br />for any reason, Lessee shall remove all buildings and improvements as directed by Lessor within <br />ninety (90) days following termination of this Lease. Lessee agrees to fill in all excavations with <br />solidly compacted earth and to leave said Premises in a neat and clean condition following any <br />such removal save and except normal wear and tear and acts beyond Lessee’s control. Should <br />Lessee fail to complete the removal of Lessee’s facilities within thirty (30) days following <br />termination of this Lease, Consideration shall accrue at Hold-Over rates until all improvements <br />have been satisfactorily removed and the Premises have been left in satisfactory condition. <br />Within thirty (30) days following termination of this Lease, Lessee shall at Lessee’s expense <br />eliminate and pay in full any encumbrances, liens, and debts incurred by Lessee with respect to <br />any improvements to remain on the property. <br />32. NOTICE <br />Any notice required or desired to be given or served under this Lease shall be deemed properly <br />given or served if sent by registered mail, postage prepaid, addressed to Lessor at 375 11th <br />Street, Oakland, California 94607 Attn: Manager of Real Estate Services MS# 903, or Lessee at <br />_______________________City Manager, City of San Leandro, 835 East 14th Street, San <br />Leandro, CA, <br />94577_________________________________________________________________________ <br />______________ or at such other address as shall be last furnished in writing by one party to the <br />other. <br />547
