<br />WHEREAS, the City and Eden Housing anticipate applying for approximately twelve
<br />million dollars ($12,000,000) in AHSC program funds, which includes eight million dollars
<br />($8,000,000) for the Project and four million dollars ($4,000,000) for active transportation
<br />improvements and programs; and
<br />WHEREAS, the City is seeking authorization to apply for not to exceed fifteen million
<br />dollars ($15,000,000) in AHSC program funds, which includes ten million dollars ($10,000,000)
<br />for the Project and five million dollars ($5,000,000) for active transportation improvements and
<br />programs, in order to accommodate potential changes in the scope of the application and budget
<br />without the need to obtain additional authorization from the City Council; and
<br />WHEREAS, if the application is approved, Eden Housing will be responsible for
<br />managing the affordable housing related loan, and the City’s Engineering and Transportation
<br />Department will administer the infrastructure-related grants.
<br />NOW, THEREFORE the City Council of the City of San Leandro does RESOLVE as
<br />follows:
<br />1. The City Manager, on behalf of the City of San Leandro, is hereby authorized and
<br />directed to apply for and submit to the Department the AHSC Program Application as detailed in
<br />the Notice of Funding Availability dated October 2, 2017, for Round 3 in a total amount not to
<br />exceed $15,000,000 of which $10,000,000 is requested as a loan for an Affordable Housing
<br />Development (“AHSC Loan”) and $5,000,000 is requested for a grant for Housing-Related
<br />Infrastructure (HRI), Sustainable Transportation Infrastructure, Transit-Related Amenities or
<br />Program activities (“AHSC Grant”) as defined by the AHSC Program Guidelines adopted by
<br />Sustainable Growth Council on July 17, 2017, errata August 14, 2017 and October 23, 2017. If
<br />the application is approved, the City is hereby authorized and directed to enter into, execute, and
<br />deliver a State of California Standard Agreement (“Standard Agreement”) in a total amount not to
<br />exceed $15,000,000 ($10,000,000 for the AHSC Loan and $5,000,000 for the AHSC Grant), and
<br />any and all other documents required or deemed necessary or appropriate to secure the AHSC
<br />Program funds from the Department, and all amendments thereto (collectively, the “AHSC
<br />Documents”.)
<br />2. The City will be subject to the terms and conditions as specified in the Standard
<br />Agreement. Funds are to be used for allowable capital asset project expenditures to be identified
<br />in Exhibit A of the Standard Agreement. The application in full is incorporated as part of the
<br />Standard Agreement. Any and all activities funded, information provided, and timelines
<br />represented in the application are enforceable through the Standard Agreement. The City hereby
<br />agrees to use the funds for eligible capital asset(s) in the manner presented in the application as
<br />approved by the Department and in accordance with the Notice of Funding Availability and
<br />Program Guidelines and Application Package.
<br />3. The City Manager is authorized to execute the AHSC Program Application Package
<br />and the AHSC Documents as required by the Department for participation in the AHSC Program
<br />and to take all actions necessary to carry out the intent of this Resolution.
