196 ~ CiTY OF SAN LEANDRO BiCYCLE & PEDESTRiAN MASTER PLAN <br />Federal/Nationwide Plans & Guides <br />FAST ACT (2015) <br />The Fixing America’s Surface Transportation Act provides long-term funding <br />certainty for surface transportation infrastructure planning and investment. <br />The FAST ACT authorizes $305 billion over fiscal years 2016 through 2020, <br />maintaining a focus on safety. <br />AASHTO Guide for the Development of Bicycle <br />Facilities <br />The American Association of State Highway and Transportation Officials <br />(AASHTO) Guide for the Development of Bicycle Facilities offers planning <br />and design guidance for the development of bicycle and pedestrian facilities. <br />The Guide covers topics ranging from high-level bikeway network planning to <br />specific facility design. <br />NACTO Urban Bikeway Design Guide <br />The NACTO Urban Bikeway Design Guide provides cities with state-of-the- <br />practice solutions that can help create complete streets that are safe and <br />enjoyable for bicyclists. <br />Americans with Disabilities Act (1990) <br />The Americans with Disabilities Act (ADA) provides thorough civil liberties <br />protections to individuals with disabilities with regards to employment, <br />State and local government services, access to public accommodations, <br />transportation, and telecommunications. <br />Title iii of the act requires places of public accommodation to be accessible <br />and usable to all people, including those with disabilities. While the letter of <br />the law applies to “public accommodations,” the spirit of the law applies not <br />only to public agencies but to all facilities serving the public, whether they are <br />publicly or privately funded. <br />Title ii of the act requires that all government services, programs, and activities <br />be accessible to and usable by persons with disabilities. However, Title 28 of the <br />Code of Federal Regulations, Section 35.150(a), states that if the public entity <br />can demonstrate that modifications would fundamentally alter the nature of <br />its service, program, or activity, or cause undue financial and administrative <br />burdens, it is not required to make that particular modification. <br />334
