Environmental Checklist Biological Resources <br /> Initial Study – Mitigated Negative Declaration 27 <br />minimum buffer of 250 feet for raptors) shall be established around such active nests <br />and no construction shall be allowed in the buffer areas until a qualified biologist has <br />determined that the nest is no longer active (i.e., the nestlings have fledged and are no <br />longer reliant on the nest). No ground-disturbing activities shall occur in this buffer until <br />the qualified biologist has confirmed that breeding/nesting is completed and the young <br />have fledged the nest. Nesting bird surveys are not required for construction activities <br />occurring between August 31 and February 1. <br />Implementation of Mitigation Measure BIO-1 would ensure protection of nesting birds that may be <br />present on the site during construction activities. These measures would reduce the potentially <br />significant impact to special-status species to a less than significant level. <br />LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATED <br />b. Would the project have a substantial adverse effect on any riparian habitat or other sensitive <br />natural community identified in local or regional plans, policies, or regulations, or by the <br />California Department of Fish and Wildlife or U.S. Fish and Wildlife Service? <br />The project site does not contain riparian habitat or sensitive natural communities as identified by <br />the California Department of Fish and Wildlife or the United States Fish and Wildlife Service (San <br />Leandro 2016a). There would be no impact. <br />NO IMPACT <br />c. Would the project have a substantial adverse effect on federally protected wetlands as defined <br />by Section 404 of the Clean Water Act (including, but not limited to, marsh, vernal pool, coastal, <br />etc.) through direct removal, filling, hydrological interruption, or other means? <br />The project site does not contain federally protected wetlands as defined by Section 404 of the <br />Clean Water Act (CWA), and would not result in the direct removal, filling, or hydrological <br />interruption of any wetlands (U.S. Fish and Wildlife Service 2016). There would be no impact. <br />NO IMPACT <br />d. Would the project interfere substantially with the movement of any native resident or migratory <br />fish or wildlife species or with established native resident or migratory wildlife corridors, or <br />impede the use of native wildlife nursery sites? <br />The project site does not contain hydrologically connected waters that would support native <br />resident or migratory fish. In addition, the project site is not located in a migratory wildlife corridor <br />(San Leandro 2016a). As the project site does not including sensitive biological resources or <br />movement corridors, its implementation would not interfere with the movement of native resident <br />or migratory fish or wildlife species or with established native resident or migratory wildlife <br />corridors, or impede the use of native wildlife nursery sites. There would be no impact. <br />NO IMPACT <br />e. Would the project conflict with any local policies or ordinances protecting biological resources, <br />such as a tree preservation policy or ordinance? <br />Article 19, 4-1906 of the City’s Zoning Code outlines the requirements for the preservation or <br />replacement of trees on development sites. Plans submitted for approval are required to “identify <br />all existing trees with a trunk diameter equal or greater than six (6) inches in diameter as measured <br />324
