existing physical boundaries of a Unit or of a Unit reconstructed in substantial
<br />accordance with the original plan shall be conclusively presumed to be its boundaries,
<br />rather than the description expressed in the deed or Condominium Plan, regardless of
<br />minor variance between boundaries shown on the Condominium Plan or in the deed
<br />and those of the building and regardless of settling or lateral movement of the building.
<br />Whenever reference to a Unit is made in this Declaration, in the Condominium Plan, in
<br />any deed, or elsewhere, it shall be assumed that such reference is made to the Unit as
<br />a whole, including each of its component elements.
<br />1.29 Utility Systems. “Utility Systems” means any sanitary sewer, drainage,
<br />water, electric, and gas, pipes, fire sprinkler system, cables and/or lines, as the case
<br />may be, serving any Unit or the Common Area.
<br />ARTICLE 2 - APPLICABILITY OF RESTRICTIONS
<br />2.1 Submission. Declarant declares that the Project is, and shall be, held,
<br />conveyed, hypothecated, encumbered, sold, leased, rented, used, occupied and
<br />improved subject to each and all of the limitations, covenants, conditions, restrictions,
<br />easements, liens, charges, assessments and equitable servitudes set forth herein, all of
<br />which are declared and agreed to be in furtherance of a plan of condominium
<br />ownership as described in the Act for the subdivision, improvement, protection,
<br />maintenance, and sale of Condominiums within the Project, and all of which are
<br />declared to be for the purpose of enhancing, maintaining and protecting the value,
<br />desirability and attractiveness of the Project and every part thereof. All of the
<br />limitations, covenants, conditions, restrictions, easements, liens, charges, assessments
<br />and equitable servitudes set forth herein shall run with, be binding on and inure to the
<br />benefit of each and every person having or acquiring any right, title or interest in the
<br />Project, and shall be binding upon and inure to the benefit of the successors in interest
<br />of such persons.
<br />2.2 Incorporation of Declaration Into Instruments. Any deed or other
<br />instrument by which a Condominium is conveyed shall be subject to the provisions of
<br />this Declaration and shall incorporate the provisions of this Declaration, whether or not
<br />such deed or other instrument makes reference hereto.
<br />ARTICLE 3 - COMPLIANCE WITH GOVERNING DOCUMENTS
<br />3.1 Compliance with Governing Documents. All present and future Owners,
<br />occupants and tenants of Units within the Project shall be subject to, and shall comply
<br />with, each and every provision of the Governing Documents, as the same or any of
<br />them shall be amended from time to time, unless a particular provision is specifically
<br />restricted in its application to one or more of such classes of persons (i.e., Owners,
<br />tenants, invitees, etc.). The acceptance of a deed to any Condominium, the entering
<br />into a lease, sublease or contract of sale with respect to any Unit, or the occupancy of
<br />any Unit shall constitute the consent and agreement of such Owner, tenant or occupant
<br />that each and all of the provisions of the Governing Documents, as the same or any of
<br />them may be amended from time to time, shall be binding upon such Owner, tenant or
