1.20 Insurer or Guarantor. “Insurer” or “Guarantor” shall mean an insurer or <br />governmental guarantor of a Mortgage. <br />1.21 Map. “Map” shall mean and refer to that Parcel Map No. 10850, filed for <br />record the day of , 20 , in Book of Parcel Maps at pages <br />and , Alameda County Records. <br />1.22 Member. “Member” means every person or entity holding a membership <br />in the Association, and whose rights as a Member are not suspended pursuant to <br />Section 7.1(D). <br />1.23 Mortgage. “Mortgage” means a bona fide mortgage or deed of trust which <br />encumbers a Condominium or other portion of the Project. <br />1.24 Mortgagee. “Mortgagee” means the beneficiary under a deed of trust and <br />any guarantor or insurer of a Mortgage. A “first” Mortgage, or “first” Mortgagee is one <br />having priority as to all other Mortgages or holders of Mortgages encumbering the same <br />Condominium or other portions of the Project. An “institutional” Mortgagee is a <br />Mortgagee that is a bank or savings and loan association or Mortgage company or <br />other entity chartered or licensed under federal or state laws whose principal business <br />is lending money on the security of real property or investing in such loans, or any <br />insurance company or any federal or state agency or instrumentality, including, without <br />limitation, the Federal National Mortgage Association and the Federal Home Loan <br />Mortgage Corporation. The term “Mortgagee” also shall mean the United States <br />Department of Housing and Urban Development, or the United States Department of <br />Veterans Affairs, if either are a first Mortgagee or a first Mortgagee Insurer or <br />Guarantor. <br />1.25 Owner. “Owner” means the record fee title Owner, whether one or more <br />persons or an entity, of a fee simple title to any Condominium and shall include a <br />contract purchaser, provided the contract purchaser is in possession under a recorded <br />contract of sale. “Owner” shall also mean Member of the Association. “Owner” shall <br />not include any person who holds an interest in a Condominium merely as security for <br />the performance of an obligation or as a tenant. <br />1.26 Project. “Project” means the Property and all the Improvements on the <br />Property. <br />1.27 Property. “Property” means that parcel of real property described in <br />Recital A, and more particularly described in Exhibit A attached. <br />1.28 Unit. “Unit” means the elements of a Condominium that are not owned in <br />common with the other Owners of Condominiums in the Project. Such Units and their <br />respective boundaries are shown on and more particularly described in the <br />Condominium Plan, deeds conveying Condominiums, and this Declaration. “Unit” does <br />not include other interests in real property that are less than estates in real property, <br />such as exclusive or nonexclusive easements.
