and powers of the Association are to provide for the operation, control and maintenance <br />of certain parts of the Project, and to provide enforcement of the provisions of the <br />Governing Documents and any other instruments relating to the management and <br />control of the Association and the Project. Without in any way limiting the generality of <br />the foregoing, the Association shall have the power and authority to do all of the <br />following acts: <br />(A)Contracts. The Association shall have the right and power to <br />contract for such services, labor, goods and materials for those parts of the Project the <br />Association is responsible to maintain as it may deem reasonable or necessary. <br />(B)Maintenance. The Association shall have the power to maintain, <br />repair, and make capital Improvements to the Project in accordance with Article 8. The <br />Association may also purchase equipment, tools, supplies and other personal property <br />as the Association deems necessary for use in such maintenance and repair. <br />(C)Assessments. The Association shall have the power to fix, levy, <br />and collect Assessments as provided in Article 12. <br />(D)Association Rules. The Association shall have the power from time <br />to time and subject to the provisions of Article 5 of Chapter 3 of the Act (Civil Code <br />Section 4340 et seq.), and this Declaration and Bylaws, to adopt, amend and repeal <br />Association Rules which may include the establishment of a system of monetary <br />penalties for failure of an Owner to comply with the provisions of the Governing <br />Documents. The Association Rules shall not be inconsistent with the provisions of the <br />Articles, Bylaws or this Declaration. No Association Rule may be adopted which <br />discriminates among Owners or which materially affects the rights, preferences or <br />privileges of any Owner set forth in this Declaration or Bylaws. In the event of a breach <br />or threatened breach of the Association Rules or any provision of the Governing <br />Documents by any Owner, such Owner’s tenant, guest or invitee, or an occupant of <br />such Owner’s Unit, the Association may impose financial penalties on such Owner as <br />provided herein, and/or may temporarily suspend the voting rights of such Owner. The <br />imposition of any financial penalties or suspension of voting rights for violations of an <br />Association Rule must conform to the notice and hearing requirements set forth in <br />Section 7.4. <br />Notwithstanding anything to the contrary in the Governing Documents, the <br />Association cannot be empowered to cause a forfeiture or abridgment of an Owner’s <br />right to the full use and enjoyment of his or her Condominium on account of the failure <br />by the Owner to comply with provisions of the Governing Documents, including duly <br />enacted Association Rules, except by judgment of a court or a decision arising out of an <br />arbitration or on account of a foreclosure or sale under a power of sale for failure of the <br />Owner to pay Assessments duly levied by the Association. <br />(E)Right to Enter.
