E MERGENCY M EDICAL S ERVICES F IRST R ESPONDER A DVANCED L IFE S UPPORT A GREEMENT (7 /1/201 9 ) <br />Page 12 of 24 <br />13.3 Failure to Meet Minimum In-Service Equipment/Supply Requirements - Notification shall be <br />made to the County for a failure by the City to meet minimum in-service equipment/supply <br />requirements. If the County becomes aware of a possible failure to meet in-service <br />requirements prior to the City, the County shall notify the City. Upon recognition or <br />notification of a failure to meet minimum requirements, the FRALS unit shall be taken out of <br />service until the City can validate that the minimum in-service equipment/supply <br />requirements are met. <br />SECTION 14 - COOPERATION WITH EMS SYSTEM/COMMUNITY EDUCATION <br />14.1 City shall submit an updated plan for medical education programs for the community in its <br />service area and submit a report to EMS no later than February 1st of each year describing <br />these programs. <br />14.2 City agrees to participate and assist in the development of system changes subject to <br />negotiated costs, if any. <br />14.3 County agrees to continue obtaining input from all participating Cities prior to <br />implementing change to system policies and procedures. <br />14.4 City shall participate and assist in changes related to emergency medical services in <br />Alameda County through their participation in committee meetings, and work groups (e.g.: <br />Emergency Medical Oversight Committee, Quality Council and Data Steering Committee).. <br />SECTION 15 - ADMINISTRATIVE PROVISIONS <br />15.1 Material Breach <br />a. Willful failure of City to provide Services under this Agreement in substantial <br />compliance with the requirements of the applicable Federal, State, and County of <br />Alameda laws, rules, and regulations shall constitute a material breach. Minor <br />infractions of such requirements shall not constitute a material breach unless such <br />infractions are willful and repeated. <br />b. Acts or omissions that shall constitute a material breach by City include but are not <br />limited to the following: <br /> Willful falsification of data supplied to County during the course of operations, <br />including but not limited to dispatch data, patient report data, Response Time data, <br />financial data, or falsification of any other data required under Agreement; <br />670
