D. The property owner, occupant and tenants shall maintain trash area/enclosure free <br />of litter and other debris in accordance with San Leandro Municipal Code §3-15- <br />215. <br />E. All flow shall be metered in a location downstream from all lateral connections <br />and prior to the City's main. This location shall have provisions for monitoring <br />the wastewater stream and shall be completed as part of this project. <br />B. City staff shall be able to monitor the flow meter and wastewater discharge per <br />the applicant's discharge permit. <br />C. If, in the 24 months after receiving a final building inspection, the maximum <br />monthly loadings exceed the previous 12 months' maximum of 0.19 MGD, 4868 <br />Pounds of BOD per day and 1729 Pounds of TSS per day for or two consecutive <br />months, the applicant agrees to pay the original capacity charge of 51,295,277. <br />D. The applicant agrees that the City may calculate a 12 month average loading <br />within 24 months of the applicant receiving a final building inspection and use <br />this 12 month average to calculate a. capacity charge using the rates in effect at <br />that time. <br />E. The applicant agrees that capacity charges may be included in permits for future <br />building permits if the proposed project will increase processing capacity even if <br />no new square footage is added in the project. This new charge may be mitigated <br />by installing a system to treat the discharge before it discharging to the City's <br />sewer system. <br />VIII. CONSTRUCTION PROVISIONS <br />A. Pest and vermin control shall be instituted prior to the demolition and construction <br />of the project. <br />B. During construction the following high standards for sanitation are required: <br />Garbage cans, construction dumpsters, and debris piles shall be removed on a <br />minimum weekly basis. All food related trash items such as wrappers, cans, bottles, <br />and food scraps shall be disposed of in closed containers only and shall be regularly <br />removed from the site. At no tirrie shall debris remain on Site unattended within <br />the front. yard sethack of the property.
