<br />Proposed Amendments Related to East 14 Street Development Strategy City of San Leandro Zoning Code - Article 6
<br />2.That the proposed location of the Restaurant, Full-Service or Café and the
<br />proposed conditions under which it would be operated or maintained will be
<br />consistent with the General Plan; will not be detrimental to the public health,
<br />safety or welfare of persons residing, or working in, or adjacent to, the
<br />neighborhood of such use; and will not be detrimental to properties or
<br />improvements in the vicinity, or to the general welfare of the City;
<br />3.That the proposed Restaurant or Café will not create adverse impacts on
<br />traffic, including but not limited to on-street parking demand, or create
<br />demands exceeding the capacity of public services and facilities which
<br />cannot be mitigated
<br />H.Fast Food Establishments, Small Scale in the CC District, are subject to
<br />Administrative Review if the proposal is to establish or enlarge a Fast Food
<br />Establishment, Small Scale within five hundred (500) feet of a Residential District.
<br />Zoning permit review pursuant to Article 21 shall include but is not limited to a
<br />review of the proposal’s generation of parking demand, hours of operation, and
<br />signage. In order to assure consistency with the purpose of the applicable
<br />Commercial District, the Zoning Enforcement Official may impose conditions to
<br />limit hours of operations and signage further than what is prescribed elsewhere in
<br />this Code. The standard for approval is the Zoning Enforcement Official’s ability to
<br />make the required findings, as listed below:
<br />1.That the proposed location and operation of the Fast Food Establishment,
<br />Small Scale, is in accord with the provisions of this code, and the purposes
<br />and specific standards of the C Commercial District in which the site is
<br />located;
<br />2.That the proposed location of the Fast Food Establishment, Small Scale,
<br />and the proposed conditions under which it would be operated or maintained
<br />will be consistent with the General Plan; will not be detrimental to the public
<br />health, safety, or welfare of persons residing, or working in, or adjacent to,
<br />the neighborhood of such use; and will not be detrimental to properties or
<br />improvements in the vicinity, or to the general welfare of the City;
<br />3.That the proposed, Fast Food Establishment, Small Scale will not create
<br />adverse impacts on traffic, including but not limited to on-street parking
<br />demand, or create demands exceeding the capacity of public services and
<br />facilities which cannot be mitigated.
