IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2019-188 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO ACCEPT THE <br />WORK FOR THE ANNUAL SIDEWALK REPAIR PROGRAM 2017-18, PROJECT NO. <br />2017.0060 (PROVIDES FOR ACCEPTING THE WORK PERFORMED BY SPOSETO <br />ENGINEERING, INC., FILING THE NOTICE OF COMPLETION, RELEASING THE <br />PERFORMANCE AND PAYMENT BONDS, AND AUTHORIZING RELEASE OF THE <br />WARRANTY BOND AFTER ONE YEAR) <br />WHEREAS, pursuant to a construction contract between the City of San Leandro and <br />Sposeto Engineering, Inc., approved on March 5, 2018, by Resolution No. 2018-018, Sposeto <br />Engineering, Inc. completed the Annual Sidewalk Repair Program 2017-18, Project No. <br />2017.0060; and <br />WHEREAS, said work was completed according to the plans and specifications and to the <br />satisfaction of the Engineering and Transportation Director, who now recommends that said work <br />be accepted. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as <br />follows: <br />1. That the project is accepted; and <br />2. That the City Clerk is directed to file a Notice of Completion for said project; and <br />3. That the bonds given for performance and payment of said contract are released when <br />the statute of limitations expires upon recordation of the Notice of Completion; and <br />4. That upon completion of the one-year warranty period established pursuant to said <br />contract, and to the satisfaction of the Engineering and Transportation Director, the City Manager <br />is authorized to release the maintenance bond provided to warranty the described work. <br />Introduced by Councilmember Cox and passed and adopted this 18th day of November <br />2019, by the following vote: <br />Members of the Council: <br />AYES: Councilmembers Aguilar, Ballew, Cox, Hernandez, Lee, Lopez, Mayor Cutter (7) <br />NOES: None (0) <br />ABSENT: None (0) <br />ATTEST: <br />Leti ' iguel, Ci Clerk <br />
