City of San Leandro <br />Meeting Date: March 16, 2020 <br />Staff Report <br />Agenda Section:File Number:20-045 ATS Review <br />Agenda Number:5.A. <br />TO:City Council <br />FROM:Jeff Kay <br />City Manager <br />BY:Tom Liao <br />Community Development Director <br />FINANCE REVIEW:Liz Warmerdam <br />Interim Finance Director <br />TITLE:Staff Report for a City of San Leandro City Council Ordinance to Amend and <br />Re-chapter the San Leandro Zoning Code to Accommodate Recent Changes to <br />State law, to Make Corrections and Address Inconsistencies, and to Eliminate <br />the Cap on Cannabis Product Manufacturing Permits That Was Associated With <br />the Pilot Program. <br />SUMMARY AND RECOMMENDATIONS <br />Staff recommends the City Council approve an ordinance that will re-chapter and amend the <br />Zoning Code to: 1) establish a three-tier numbering methodology consistent with the Municipal <br />Code and Administrative Code, 2) make corrections and address inconsistencies, 3) <br />discontinue the pilot program 5-permit cap limitations placed on cannabis product manufacturing, <br />and 4) modify certain provisions consistent with recent changes to State law. Staff also proposes <br />to amend Title 5, Chapter 6 of the Administrative Code to remove the associated cannabis <br />manufacturing pilot program limitations. The proposed amendments do not modify existing <br />development standards and are intended to facilitate future Zoning Code updates, including a <br />forthcoming Zoning Code implementation of the Bay Fair Transit Oriented Development (TOD) <br />Specific Plan, as well as to ensure the Zoning Code remains consistent with recent changes in <br />State law. <br />BACKGROUND <br />The Zoning Code is a living document that requires regular maintenance in order to remain an <br />effective instrument that reflects the goals and policies of the City, consistent with City Council <br />direction. Routine Zoning Code updates are necessary to address changing conditions, <br />community needs and interests, judicial determinations, and state mandates. The City Council <br />previously considered and recommended Zoning Code updates in conjunction with the 2035 <br />General Plan Update in September 2016 and in regards to streamlining the Commercial and <br />Professional Office (“P” zoning) development standards in January, 2019.
