<br /> 93 <br />inscribed within it has no dimension less than 10 feet and a minimum area of 300 <br />square feet, shall be open to the sky, and shall not include driveways, pedestrian ac- <br />cess to units, or parking areas, or area required for front or street side yards. Common <br />open space provided on roof tops shall be surrounded by a parapet, wall, or other en- <br />closure that is at least four feet high, and shall be subject to approval by the Zoning <br />Enforcement Official. The Board of Zoning Adjustments may allow a percentage, not to <br />exceed 30 percent, of the total roof top open space provided to be used to satisfy the <br />open space requirement of Section 2.08.336 Open Space for Multi-Family Residential <br />and Mixed-Use Residential Development of this Code. To approve roof top open space, <br />the Board of Zoning Adjustments must make the following findings: <br /> <br />1. The roof top open space is readily accessible to all residents of the complex; <br /> <br />2. The roof top open space includes areas for active recreation or has significant <br />aesthetic value, or a combination thereof; and <br /> <br />3. The roof top open space is an amenity of the development which adds value to the <br />project overall. (Ord. 2001-015 § 1) <br /> <br />2.04.360 RM District—Multi-Family Dwellings, Requirements for Planting Areas <br /> <br />A. Yards Adjoining Streets. All visible portions of a required yard adjoining a street shall <br />be driveways, walks or parking areas, or planting area or landscape that may include <br />areas covered by ornamental gravel, crushed rock or similar materials. <br /> <br />B. Interior Yards. At least 50 percent of each required interior side yard and rear yard shall <br />be planting area having a minimum width of five feet adjoining a side or rear property <br />line, provided that the width of a required planting area may be reduced to three feet in <br />one side or rear yard adjoining a driveway or patio, and a nonresidential accessory <br />structure may occupy a portion of the planting area in a rear yard. <br /> <br />City Council Hearing March 2, 2020 131
