This classification also includes delicates- <br />sens, confectioneries, full service bakeries, butcher, fish and poultry shops, and produce mar- <br />kets, and may also include a sandwich shop as an accessory use. Also see “Convenience <br />Stores.” <br /> <br />Nonconforming Structure. A structure, which was lawfully erected but that does not con- <br />form to the development standards for lot coverage, setbacks, height, number of stories, <br />distance between structures, or floor area ratio prescribed in the regulations for the district <br />in which the structure is located by reason of adoption or amendment of this Code or by <br />reason of annexation of territory to the City. <br /> <br />Nonconforming Use. A use of a structure or land, which was lawfully established and <br />maintained, but that does not conform with the use regulations for the district in which it is <br />located by reason of adoption or amendment of this Code or by reason of annexation of <br />territory to the City. A use that does not conform to the parking or loading regulations appli- <br />cable to the district in which it is located shall not be considered a nonconforming use solely <br />because of one or more of these nonconformities. <br /> <br />Nonhabitable Accessory Structure. A detached subordinate structure without living <br />space, the use of which is appropriate, subordinate and customarily incidental to that of the <br />main structure or the main use of the land and which is located on the same site with the <br />main structure or use. <br /> <br />Nurseries. Any business which sells, primarily at retail, plants which are displayed <br />or otherwise merchandised outside an enclosed building. Merchandise other than plants is <br />kept with an enclosed building or a fully screened enclosure. Fertilizer of any type is stored <br />and sold in package form only. Establishments in which all merchandise other than plants <br />is kept within an enclosed building or a fully screened enclosure, and fertilizer of any type <br />is stored and sold in package form only. <br /> <br />Offices, Business and Professional. Offices of firms or organizations providing profes- <br />sional, executive, management, or administrative services, such as architectural, engineer- <br />ing, real estate, insurance, investment, legal, dental laboratories, and medical/dental offices. <br />This classification includes firms developing software or providing Internet-based services, <br />and medical/dental laboratories incidental to an office use, but excludes financial institu- <br />tions. <br /> <br />Off-Street Loading Facilities. A site or portion of a site devoted to the loading or unloading <br />of motor vehicles or trailers, including loading berths, aisles, access drives, and landscaped <br />areas. <br /> <br />Open Space, Common. Usable open space with a minimum dimension of 10 feet in any <br />direction and a minimum area of 300 square feet.
