IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />ORDINANCE NO. 2004-007 (1009/1024/1099) <br />AN ORDINANCE ADOPTING AMENDMENTS TO THE ZONING CODE <br />ARTICLES 3, 6, 10, 16, 17, 20, 22 AND 25 RELATING TO THE <br />EAST 14TH STREET SOUTH AREA DEVELOPMENT STRATEGY <br />RECITALS <br />A. In 2002, the City of San Leandro adopted a new General Plan, which includes <br />short-term and long-term goals and policies concerning the development of East 14th Street. <br />B. In October of 2001, the City Council of San Leandro was apprised of and <br />discussed recent development trends along the East 14th Street in the area south of Thornton <br />Street to the City boundary with unincorporated Alameda County (hereafter referred to as the <br />"East 14th Street South Area"). <br />C. The planning for and future development of the East 14th Street South Area is an <br />important component of the City's General Plan, forming one of ten ( 10) focus areas in the City <br />discussed in detail in the General Plan. <br />D. The City's City Council Economic Development Subcommittee and the General <br />Plan Advisory Committee have recommended that the East 14th Street South Area be the subject <br />of a new study contained in the East 141h Street South Area Development Strategy relating <br />specifically to future development, including public improvements, along this corridor, and <br />requiring changes in zoning and other development regulations affecting the East 14th Street <br />South Area. <br />E. This Ordinance does not itself approve or allow the construction of any project <br />and, therefore, has no potential for resulting in physical change in the environment, directly or <br />ultimately. Therefore, adoption of this Ordinance is exempt from environmental review under the <br />California Environmental Quality Act pursuant to Public Resources Code section 21065 based <br />on the finding that this Ordinance is not a "project" within the meaning 1of Section 15378 of the <br />State CEQA Guidelines. The adoption of this Ordinance is further exempt from environmental <br />review pursuant to Section 15305 of the State CEQA Guidelines, because it is a minor change in <br />land use regulations that will not result in any changes to underlying zoning standards. <br />NOW, THEREFORE, the City Council of the City of San Leandro does ORDAIN as <br />follows: <br />Section 1. Article 3 of the San Leandro Zoning Code is amended to add the <br />definitions set for in Exhibit A, which is attached and incorporated by reference into this <br />Ordinance. <br />Section 2. Sections 2-600, 2-606, 2-608, 2-674, 2-676, 2-678, 2-680, 2-682, 2-684, 2- <br />686, 2-688, 2-690, 2-696, and 2-698 of Article 6 of the San Leandro Zoning Code are amended <br />as set forth in Exhibit B, which is attached and incorporated by reference into this Ordinance.
