1) assumed in a contractor agreement that is a covered indemnity <br />contract, provided the bodily injury or property damage occurs <br />subsequent to the execution of the contract or agreement; or <br />2) that the covered party would have in the absence of the contractor <br />agreement. <br />Notwithstanding this exclusion, the General Manager (or Board President or Vice <br />President, in the absence of the General Manager) is granted authority to approve <br />settlements involving promises to indemnify a co-defendant as part of the <br />settlement. Any funds recovered from a co-defendant under such an agreement <br />must be applied to ultimate net loss in addition to the retained limit before CJPRMA <br />coverage is triggered. <br />6) Damages Other Than Money <br />Ultimate net loss arising out of relief, or redress, in any form other than money <br />damages. <br />7) Dams <br />Claims arising out of partial or complete structural failure of a dam owned or <br />operated by a covered party. <br />8) Defamation <br />Claims arising out of oral or written publication of material, if done by or at the <br />direction of the covered party with knowledge of its falsity. <br />Memorandum of Coverage <br />Effective: 0710112019 <br />17 <br />
