Claims arising out of the ownership, operation, maintenance or use of any vehicle <br />(1) with over 30 passengers seats or carrying over 30 passengers and (2) which is <br />owned, operated, maintained or used by any transit authority, transit system or <br />public transportation system owned or operated by or on behalf of the covered <br />party. <br />26) Nuclear Material <br />Claims arising out of the hazardous properties of nuclear material. <br />27) Pollution <br />Claims which would not have occurred in whole or in part but for the actual, alleged <br />or threatened discharge, dispersal, seepage, migration, release or escape of <br />pollutants at anytime. <br />(a) This exclusion does not apply to fire fighting activities, including training <br />burns, or intentional demolition or burns for the purpose of limiting a fire, or <br />the discharge of pollutants for the purpose of controlling a fire; or to police <br />use of mace, oleoresin capsicum (O.C.), pepper gas or tear gas; or to weed <br />abatement or tree spraying. <br />(b) This exclusion does not apply to claims arising from sudden and accidental <br />sewer backups into a home or business, but this extension of coverage does <br />not apply to backups, overflow or runoff into public waterways. <br />Notwithstanding what is stated in the applicable declarations, the limit of <br />coverage for claims described in this exception will be subject to a sublimit of <br />$5,000,000. <br />(c) This exclusion does not apply to claims arising from the sudden and accidental <br />discharge, dispersal, release, or escape of chlorine and other chemicals (gas, <br />liquid or solid) which are being used or being prepared for use in fresh or <br />wastewater treatment or in water used in swimming pools, wading pools or <br />decorative fountains. <br />Notwithstanding what is stated in the applicable declarations, the limit of <br />coverage for claims described in this exception will be subject to a sublimit of <br />$5,000,000. <br />(d) This exclusion does not apply to claims arising from materials being <br />collected as part of any drop-off or curbside recycling program implemented <br />and operated by the covered party; if the materials have not been stored by <br />the covered party or parties for a continuous period exceeding ninety (90) <br />days.
