limit of coverage for claims described in this exception will be subject to a <br />sublimit of $5,000,000. <br />(e) This exclusion does not apply to sudden and accidental discharges of <br />pollutants occurring during the transportation or deposit of materials as <br />part of garbage collection activities. However, the exclusion does apply <br />after pollutants have been deposited at a landfill or garbage dump. <br />(f) This exclusion does not apply to bodily injury or property damage arising <br />from activities of the covered party to test for, monitor, clean up, remove, <br />contain, treat, detoxify or neutralize pollutants, but this exception will not <br />apply to bodily injury or property damage caused by pollutants on or arising <br />from premises, equipment or locations under the control of the covered <br />party. <br />(g) This exclusion does not apply to sudden and accidental discharges of <br />pollutants from premises owned or controlled by a Covered Party as <br />described in Definition 8(a) or (b) if the discharge is discovered within ten <br />(10) days of the occurrence and reported to the Authority within thirty (30) <br />days of discovery. Notwithstanding what is stated in the applicable <br />declarations, the limit of coverage for claims described in this exception will <br />be subject to a sublimit of $5,000,000. <br />As used in paragraphs (b), (c), (e) and (g) above, "sudden" means abrupt or <br />immediate, and occurring within a period not exceeding twenty-four (24) hours; <br />"accidental" means causing harm neither expected nor intended by a covered party. <br />Notwithstanding what is stated in the applicable declarations, any liability arising <br />out of the actual, alleged or threatened exposure to asbestos or lead, which is <br />covered by an exception within this exclusion, shall be subject to a sublimit of <br />$5,000,000. <br />28) Pollution Clean up <br />Any loss, cost or expense, including defense costs, arising out of any: <br />(a) request, demand or order that any covered party or others test for, monitor, <br />clean up, remove, contain, treat, detoxify or neutralize, or in any way respond <br />to, or assess the effects of pollutants; or <br />(b) claim or suit by or on behalf of a governmental authority for damages <br />because of testing for, monitoring, cleaning up, removing, containing, <br />treating, detoxifying or neutralizing, or in any way responding to, or assessing <br />the effects of pollutants; or <br />Memorandum of Coverage <br />Effective: 0710112019 <br />23 <br />
