In this <br />circumstance, the lead agency shall prepare an infill EIR.”49 <br /> <br />Here, the City must prepare an Infill EIR because the Project would result in <br />new specific effects and more significant effects to housing, air quality, health risk, <br />hazardous materials, greenhouse gas emissions, noise, and traffic; and uniformly <br />applicable development standards would not substantially mitigate such effects.50 <br /> <br />A. The Project Will Cause New Significant and Unmitigated Housing <br />Impacts <br /> <br />The failure to provide sufficient inclusionary housing in this Project violates <br />the City’s Zoning Ordinance. The San Leandro Zoning Code provides that projects <br />with 50 or more units must provide 15% of total units as Inclusionary Units.51 <br />“Inclusionary Unit” means a dwelling unit that must be offered at Affordable Rent <br />or available at an Affordable Housing Cost to moderate-, low- and very low-income <br />Households.52 At the current rate required by the Zoning Code, this Project would <br />be required to include 29 inclusionary units.53 But, the Board of Zoning Adjustment <br />approved this Project with only ten inclusionary units.54 This dearth of inclusionary <br />housing is contrary to the goals set forth in the San Leandro Zoning Code and <br />Housing Element. <br /> <br />Title 6 of the San Leandro Zoning Code provides that the purpose of the <br />Inclusionary Housing Chapter is to: <br /> <br />Offset the demand on housing that is created by new development and <br />mitigate environmental and other impacts that accompany new residential <br />and commercial development by protecting the economic diversity of the <br />City’s housing stock, reducing traffic, transit and related air quality impacts, <br />promoting jobs/housing balance and reducing the demands placed on <br />transportation infrastructure in the region; and <br /> <br />49 CEQA Guidelines § 15183.3(d)(2)(C). <br />50 CEQA Guidelines § 15183.3(d)(2)(C). <br />51 San Leandro Zoning Code §6.04.112(B). <br />52 San Leandro Zoning Code §6.04.108(P). <br />53 San Leandro Zoning Code §6.04.112(B). <br />54 City of San Leandro, California, Planning Commission and Board of Zoning Adjustments, 5/6/2021 <br />7:00 PM, Meeting Video available here: <br />http://sanleandro.granicus.com/MediaPlayer.php?view_id=2&clip_id=1667. <br />71
